Recently, the National Assembly of Vietnam has issued the Law on Environmental Protection 2020, replaces the Law on Environmental Protection 2014.
According to Article 123 of the Law on Environmental Protection 2020 of Vietnam, the classification of an environmental emergency shall be based on the extent of environmental pollution or degradation at the time of discovering the emergency in order to determine an authority responsible for direction and response, including:
- In-facility environmental emergency: environmental pollution or degradation occurs within a facility;
- District-level environmental emergency: environmental pollution or degradation occurs beyond a facility and within a district;
- Provincial-level environmental emergency: environmental pollution or degradation occurs beyond a district and within a province;
- National-level environmental emergency: environmental pollution or degradation occurs within 02 provinces or more or across the nation.
Concurrently, stages of environmental emergency response include:
- Preparing for environmental emergency;
- Organizing environmental emergency response;
- Remediating the environment after an emergency.
