Law amending Law on Security Guard Force 2024 available in Vietnam

June 28, 2024, the National Assembly of Vietnam approved the Law amending Law on Security Guard Force 2024, which amended several notable provisions.

Law amending Law on Security Guard Force 2024 was approved by the 15th National Assembly of the Socialist Republic of Vietnam, 7th session on June 21, 2024.

Law amending Law on Security Guard Force 2024 available in Vietnam

Law amending Law on Security Guard Force 2024 will amend and supplement several provisions of the Law on Security Guard Force 2017 as follows:

(1) Amend and supplement several clauses of Article 3 as follows:

- Amend and supplement Clause 4 as follows:

“4. Protected subjects are individuals holding key leadership positions, including high-ranking leaders of the Communist Party of Vietnam, the State of the Socialist Republic of Vietnam, and the Central Committee of the Vietnam Fatherland Front; international guests visiting and working in Vietnam; critical areas; events of special importance and other subjects to which protective measures and policies are applied as stipulated in this Law.”;

- Add Clauses 7, 8, 9, and 10 after Clause 6 as follows:

“7. The protection regime comprises the policies that the Communist Party of Vietnam, the State of the Socialist Republic of Vietnam provide to the protected subjects specified in this Law.

  1. Security and safety inspections are protective measures applied by the Protection Forces to detect weapons, explosives, support tools, flammable substances, biological toxins, chemical toxins, radioactive substances, and other factors to promptly prevent and counter security threats and safety risks to the protected subjects.

  2. Food and drink testing are protective measures applied by the Protection Forces to promptly prevent, detect, and counter the risk of poisoning and contamination from food and drinks.

  3. Use of identification cards and badges is a protective measure applied by the Protection Forces to check and control individuals and vehicles entering and exiting the protected areas.”

(2) Add Clause 3 after Clause 2 in Article 6 as follows:

“3. The Government of Vietnam shall provide detailed regulations for Clause 2 of this Article.”

(3) Amend and supplement several clauses of Article 10 as follows:

- Amend and supplement the introductory sentence of Clause 1 as follows:

“1. Individuals holding key leadership positions, including high-ranking leaders of the Communist Party of Vietnam, the State of the Socialist Republic of Vietnam, and the Central Committee of the Vietnam Fatherland Front include:”

- Amend and supplement Points e, g, and h of Clause 1 as follows:

“e) Executive Members of the Secretariat, Members of the Politburo;

g) Members of the Secretariat;

h) President of the Central Committee of the Vietnam Fatherland Front, Chief Justice of the Supreme People's Court, Head of the Supreme People's Procuracy, Vice President, Vice Chairman of the National Assembly, Deputy Prime Minister of the Government of Vietnam.”

c) Amend and supplement Point b of Clause 2 as follows:

“b) Deputies of the heads of state, legislative bodies, and the Government of Vietnam on the principle of reciprocity, diplomatic requirements.”

d) Amend and supplement Point d of Clause 2 as follows:

“d) Other guests at the request of the Head of the Central Committee for Foreign Relations, the Chairperson of the National Assembly's Foreign Affairs Committee, or the Foreign Minister on the principle of reciprocity, diplomatic requirements.”

- Amend and supplement Point dd of Clause 4 as follows:

“dd) Conferences and festivals organized by the central committee of the Communist Party of Vietnam, the President, the National Assembly, the Standing Committee of the National Assembly, the Government of Vietnam, or the Prime Minister of the Government of Vietnam attended by the protected subjects specified in Points a, b, c, or d of Clause 1 of this Article; the national delegate congress organized by central socio-political organizations; international conferences held in Vietnam attended by the protected subjects specified in Points a, b, c, d of Clause 1 or Point a of Clause 2 of this Article.”

- Amend and supplement Clause 5 and add Clause 6 after Clause 5 as follows:

“5. Based on the political security situation in different periods, the Government of Vietnam shall present to the Standing Committee of the National Assembly for approval, the inclusion of additional protected subjects and the application of suitable protective measures and policies according to Articles 11, 11a, 12, 12a, 13, and 14 of this Law.

  1. In necessary cases to protect national security, ensure social order and safety, and guarantee foreign affairs activities, the Minister of Public Security shall decide on the appropriate protective measures for subjects not specified in Clauses 1, 2, 3, 4, and 5 of this Article.”

Law amending Law on Security Guard Force 2024 takes effect in Vietnam from January 1, 2025.
