Additional cases of exemption from discipline in Vietnam are as follows:
- Party member is a woman who is pregnant, on maternity leave, is raising a child under 12 months old, or a male party member (in case his wife dies or due to other objective or force majeure reasons) is raising a child under 12 months of age.
(Additional case where a male party member (in case his wife dies or due to other objective or force majeure reasons) is raising a child under 12 months old is added compared to the previous regulations.)
- Party members who are seriously ill and are undergoing inpatient treatment at the hospital will not be disciplined. Only when their health is stable (discharged from the hospital) will they be disciplined.
- Violating Party members have died, the party organization shall consider and draw conclusions but do not decide on disciplinary action, except for cases of particularly serious violations.
- Party members who are declared missing, if detecting violations, still have to consider and draw conclusions but have not yet disciplined. (New rules added)
- Party members implement the proposal on innovation and creativity according to Conclusion 14-KL/TW, dated September 22, 2021, of the Politburo, approved by the competent authority, but if damage occurs, the agency has the authority to clearly identify objective and subjective causes, to make an objective and comprehensive assessment;
If the policy has been properly implemented with a pure motive for the common good, discipline or responsibility will be relieved. (New rules added)
- Violations of following wrong guidelines, decisions, or orders of the organization or superior or due to coercion but have been proactively and promptly reported in writing to competent organizations or agencies that know their opinions and proposals before implementation will be exempt from discipline in Vietnam. (New rules added)
Regulation 69-QD/TW takes effect in Vietnam from the date of signing and replaces Regulation 102-QD/TW in 2017, Regulation 07-QDi/TW in 2018.
