Latest procedures for the provision of support for vocational education in Vietnam in 2024 (Internet image)
On March 29, 2024, the Ministry of Labor - Invalids, and Social Affairs issued Decision 351/QD-BLDTBXH on the announcement of amended employment-related administrative procedures under the Ministry of Labor - Invalids, and Social Affairs.
(1) Procedure:
- Step 1: Workers who have a need for vocational education must submit a request for support for vocational education to the employment service center where they have the need for vocational education.
- Step 2: The employment service center is responsible for reviewing the request for support for vocational education and giving the worker an appointment slip for the result according to Form 01 issued together with Decree 61/2020/ND-CP.
- Step 3: Within a working period of 20 days, starting from the date of receiving the complete request for support for vocational education, the job service center submits to the Director of the Department of Labor - Invalids and Social Affairs a decision on support for vocational education according to Form 04 issued together with Decree 61/2020/ND-CP for the worker when the worker meets all the conditions for support for vocational education as prescribed.
- Step 4: Within 03 working days stated on the appointment slip for the result, the worker must come to receive the decision on support for vocational education.
(2) Document requirements:
- For workers awaiting the result of unemployment allowance settlement or currently receiving unemployment allowances but who have a need for vocational education in the localities where they are awaiting the result or receiving unemployment benefits, they must submit a request for support for vocational education according to Form 03 issued together with Decree 61/2020/ND-CP.
- For workers receiving unemployment allowances but having a need for vocational education in localities other than where they are receiving unemployment allowances, they must submit a request for support for vocational education according to Form 03 issued together with Decree 61/2020/ND-CP and a decision on receiving unemployment allowances (original or certified copy or copy attached to the original for comparison).
- For workers who do not fall into the above-mentioned cases, they must submit:
+ Request for unemployment allowances according to Form 03 issued together with Circular 15/2023/TT-BLDTBXH;
+ Request for support for vocational education according to Form 03 issued together with Decree 61/2020/ND-CP;
+ Original or certified copy or copy attached to the original for comparison of one of the documents confirming the termination of the employment contract or work contract;
+ Social insurance book.
(3) Requirements and conditions for administrative procedure implementation:
- Workers must participate in unemployment insurance when working under a employment contract or work contract as follows:
+ Employment contract or work contract without a fixed term;
+ Employment contract or work contract with a fixed term;
+ Seasonal employment contract or a specific task contract with a term of 03 months to less than 12 months.
In the case where a worker enters into and is performing multiple employment contracts as stipulated above, the worker and the employer of the first labor contract are responsible for participating in unemployment insurance.
- Termination of employment contract or work contract, except for the following cases:
+ Worker unilaterally terminates the employment contract, work contract in violation of the law;
+ Receiving pension, monthly labor capacity allowance.
- Having paid unemployment insurance for at least 9 months within the 24 months prior to the termination of the employment contract or work contract.
- Having submitted a request for unemployment benefits at the employment service center.
- Not finding a job within 15 days, starting from the date of submitting the request for support for vocational education, except for the following cases:
+ Performing military service, public security obligations;
+ Attending a course with a duration of 12 months or more;
+ Complying with a decision to be sent to a reformatory, compulsory education facility, or compulsory rehabilitation facility;
+ Being detained; serving a prison sentence;
+ Settling abroad, working overseas under a contract;
+ Deceased.
More details can be found in Decision 351/QD-BLDTBXH, which will come into effect on March 29, 2024.
