The Ministry of Justice of Vietnam has just announced the amended and supplemented administrative procedures related to judicial expertise under the management of the Ministry of Justice.
Latest procedures for reissuing the judicial expert’s identity cards in Vietnam (central level) (Internet image)
On May 17, 2024, the Ministry of Justice of Vietnam issued Decision 853/QD-BTP on the announcement of the amended and supplemented administrative procedures related to judicial expertise under the management of the Ministry of Justice.
(1) Implementation process:
The Minister of Public Security, the Minister of National Defense shall consider and propose the Minister of Health to reissue the judicial expert’s identity cards under their management authority.
The Minister of National Defense, the Prosecutor General of the Supreme People's Procuracy shall consider and propose the Minister of Public Security to reissue the judicial expert’s identity cards under their management authority.
The Ministers, Heads of ministerial agencies shall reissue the judicial expert’s identity cards for those operating in central agencies in the field under their management authority, at the proposal of the Heads of units under the ministry, ministerial agency assigned to manage the judicial expertise activities.
Within 10 days from the date of receiving the application for reissuing the judicial expert’s identity cards, the Head of the unit under the ministry, the ministerial agency assigned to be the focal point for managing judicial expertise activities, shall submit to the Minister, Head of the ministerial agency, the decision to reissue the judicial expert’s identity cards.
Within 10 days from the date of receiving the complete dossier for reissuing the judicial expert’s identity cards, the Minister, Head of the ministerial agency shall decide to reissue the judicial expert's card; in case of refusal, they must notify in writing and clearly state the reason.
(2) Submission method: The dossier shall be sent directly, through the postal system or online (if the administrative procedure has been provided online), to the competent ministry or ministerial agency.
(3) Components:
- Application for reissuing the judicial expert’s identity cards. In case the card is lost or there are changes in the information printed on the card, the application for reissuing the judicial expert’s identity cards must be certified by the managing agency or unit.
- The current judicial expert’s identity cards in case of changes in the information printed on the card; the judicial expert’s identity cards in case the old card is damaged.
- 02 color portrait photos size 2cm x 3cm (taken within the last 6 months), of the person requesting reissuance of the judicial expert’s identity card.
(4) Quantity: 01 set.
(5) Processing time:
Within 10 days from the date of receipt of the application for re-issuance of the judicial expert’s identity card, the head of the unit under the ministry or ministerial agency assigned to be the focal point for the management of forensic activities shall submit to the Minister, the Head of the ministerial agency for decision on re-issuance of the judicial expert’s identity card.
Within 10 days from the date of receiving the complete application for re-issuance of the judicial expert’s identity card, the Minister, the Head of the ministerial agency shall decide on the re-issuance of the judicial expert’s identity card; in case of refusal, they must notify in writing and clearly state the reason.
(6) In-charge authority:
The Minister of Health shall re-issue the judicial expert’s identity card within their authority.
The Minister of Public Security re-issues the judicial expert’s identity card within their management authority.
The Minister, the Head of the ministerial agency re-issues the judicial expert’s identity card for experts operating at central agencies in the field under their management authority, upon the proposal of the head of the unit under the ministry or ministerial agency assigned to manage judicial expertise activities.
