The Ministry of Culture, Sports, and Tourism issued Decision 3684/QD-BVHTTDL dated December 27, 2022, on the announcement of standardized administrative procedures in 2022 within the scope of management functions of the Ministry of Culture, Sports, and Tourism.

Procedures for reissuing relevant rights registration certificates at the central level are prescribed as follows:

1. Components of dossier for re-issuance of central-level related rights registration certificate in Vietnam

Components of the dossier for re-issuance of the central-level related rights registration certificate include:

- Related rights registration declaration (Form No. 02 issued with Circular 08/2016/TT-BVHTTDL).

Related rights registration declaration

The declaration must be made in Vietnamese and signed by the relevant rights owner or the person authorized to submit the application and contain full information about the applicant and related rights owner; a summary of the performance, audio recording, video recording, or broadcast; time, place, and form of announcement; Commitment to responsibility for the information stated in the application;

- Two copies of the identification of the object registered for related rights;

* Number of documents: 01 set.

2. Procedure for reissuing the certificate of registration of related rights at central level in Vietnam

The re-issuance of relevant rights registration certificates at the central level is carried out as follows:

- Related rights owners wishing to re-issue the Related Rights Registration Certificate shall submit an application for re-issuance of the Related Rights Registration Certificate at the headquarters of the Copyright Office or Representative of the Copyright and Related Rights Registration Office of the Copyright Department in Ho Chi Minh City, Representative of the Copyright and Related Rights Registration Office of the Copyright Department in Da Nang City.

In addition, the application for re-issuance of the relevant rights registration certificate can be sent by post.

- The Copyright Office re-issues the Related Rights Registration Certificate in case the Related Rights Registration Certificate is lost or torn.

* Processing time: 07 working days from the date of receipt of a valid application.

3. How to re-issue the relevant rights registration certificate at central level in Vietnam

Submit directly or by mail to the Copyright Department, Representative of the Copyright and Related Rights Registration Office of the Copyright Department in Ho Chi Minh City, Representative of the Copyright and Related Rights Registration Office of the Copyright Department in Da Nang city.

Or apply online at the Public Service Portal of the Ministry of Culture, Sports, and Tourism.

4. Fees for reissuing relevant rights registration certificates at the central level in Vietnam

Individuals and organizations carrying out procedures to re-issue central-level related rights registration certificates must pay the corresponding fees as follows:

- Fee for reissuing the Certificate of Related Rights for performances fixed on Sound Recordings: 100,000 VND/Certificate.

- Fee for reissuing the Certificate of related rights for the performance fixed on the Video Recording: 150,000 VND/Certificate.

- Fee for reissuing the Certificate of related rights for performances fixed on the Broadcast Program: 250,000 VND/Certificate.

- Fee for re-issuance of Related Rights Certificate for Sound Recordings: 100,000 VND/Certificate.

- Fee for re-issuance of related rights certificate for Video Recordings: 150,000 VND/Certificate.

- Fee for reissuing the Certificate of related rights for the Broadcast Program: 250,000 VND/Certificate.

More details can be found in Decision 3684/QD-BVHTTDL, taking effect on January 1, 2023, replacing Decision 3506/QD-BVHTTDL dated December 29, 2021, Decision 1785/QD-BVHTTDL dated July 28, 2021, Decision 2289/QD-BVHTTDL dated September 20, 2021.
