Latest procedures for monthly notification of job seeking in Vietnam (Internet image) 

On March 29, 2024, the Ministry of Labor - Invalids, and Social Affairs issued Decision 351/QD-BLDTBXH on the announcement of administrative procedures amended and supplemented in the field of employment within the scope of state management functions of the Ministry of Labor - Invalids, and Social Affairs.

Latest procedures for monthly notification of job seeking in Vietnam

(1) Procedures:

During the period of receiving unemployment allowances, workers must directly notify the employment service centers where they are receiving unemployment allowances about job seeking according to regulations.

The specific monthly notification date for job seeking by workers is specified in the appendix to the decision on receiving unemployment allowances as follows:

- The date of the first month of receiving unemployment allowances is the date of receiving the decision to receive unemployment allowances according to the appointment slip for results;

- From the second month onwards, workers must notify job seeking within a period of 03 working days from the first day of the month of receiving unemployment allowances.

Workers receiving unemployment allowances are considered to have made a monthly notification of job seeking when they have correctly and fully recorded the contents of the monthly notification of job seeking and are responsible for the content of the notification.

(2) Requirements, conditions for implementing administrative procedures: During the period of receiving unemployment allowances, workers must directly notify the employment service centers where they are receiving unemployment allowances about job seeking, except for specific cases as follows:

- Workers receiving unemployment allowances do not have to make monthly notification of job seeking if the notification period for job seeking falls within the period when the workers fall into one of the following cases:

+ Men aged 60 and above, women aged 55 and above;

+ Illness confirmed by authorized medical facilities;

+ Maternity leave is confirmed by authorized medical facilities. In the case of a male worker whose wife dies after giving birth and has to directly take care of the child, the confirmation documents are the birth certificate of the child and the death certificate of the mother;

+ Accidents confirmed by traffic police or authorized medical facilities;

+ Fire, flood, earthquake, tsunami, disaster, epidemic confirmed by the Chairman of the People's Committee of the commune, ward, or town;

+ Father, mother, spouse, or child of the worker dies; the worker or the worker's child gets married with a confirmation letter from the People's Committee of the commune, ward, or town;

+ Participating in vocational training courses according to the decision of the Director of the Department of Labor - Invalids and Social Affairs and having a confirmation letter from the vocational training institution;

+ Performing labor contracts with a duration of less than 01 month;

+ Voluntarily undergoing detoxification with confirmation from the detoxification facility or confirmation from the Chairman of the People's Committee of the commune, ward, or town;

+ Transferring the place of receiving unemployment allowances: in the case where the worker's job seeking notification date falls within a period of 15 working days from the date of receiving the application for transferring the place of receiving unemployment allowances, but before the worker submits the application for transferring the place of receiving unemployment allowances to the employment service centers of the new location, the worker does not have to directly notify job seeking on a monthly basis.

Workers must inform the employment service centers (via telephone, email, fax, etc.) of the reasons for not directly notifying and within a period of 03 working days from the last day of the monthly job seeking notification period as prescribed; at the same time, send a guarantee letter or authorize another person to submit the original or certified copy of one of the above-mentioned documents proving that they are not required to directly notify the employment service centers where they are receiving unemployment allowances, except for male workers aged 60 and above, and female workers aged 55 and above. In the case of sending by post, the date considered as the date of sending the notification is the date stamped on the postal stamp.
