The Central Office of the Vietnam Communist Party has issued a document informing the opinion of the Politburo, in which there is an amendment to the Guidelines towards not disciplining Party members who have a third child or more.

The Office of the Central Committee of the Communist Party issued Official Dispatch 13421-CV/VPTW in 2025 summarizing the implementation of Resolution 21-NQ/TW on population work in the new situation and amending the regulations of the Communist Party and the State related to population policy.
The document clearly states that at the meeting on February 14, 2025, after considering the proposal from the Central Inspection Committee to review the Communist Party's regulations regarding violations of population policy and the report from the Party Committee of the Ministry of Health on the 7-year summary of the implementation of Resolution 21-NQ/TW, dated October 25, 2017, of the Central Committee of the Communist Party, term XII; the opinions of the relevant agencies, the Politburo has the following opinions:
- Basically agreed with the content and the recommendations stated in the 7-year implementation evaluation report of Resolution 21-NQ/TW of the Central Committee of the Communist Party, term XII on population work in the new situation and the results of reviewing the Communist Party's regulations related to the handling of violations of population policy.
- Agreed to issue the Politburo's conclusions on continuing the implementation of Resolution 21-NQ/TW dated October 25, 2017, of the Central Committee of the Communist Party, term XII regarding population policy in the new situation.
Assigned the Party Committee of the Government of Vietnam to direct the Party Committee of the Ministry of Health to study, absorb the opinions of the Politburo, and the comments of relevant agencies (including a aggregated document with detailed comments attached) to finalize the Politburo's Conclusions for consideration and issuance by the Standing Secretariat.
- Assigned the Party Committee of the National Assembly, the Party Committee of the Government of Vietnam to coordinate leadership, and direct the acceleration of the process of formulating and submitting the Population Law for approval by the National Assembly in accordance with the spirit of the XIIIth Party Congress Resolution within 2025. In the immediate term, urgently review and amend the legal documents with regulations on the number of children (especially Ordinance 06/2003/PL-UBTVQH11 on January 9, 2003, and Ordinance 08/2008/UBTVQH12, on December 27, 2008, from the Standing Committee of the National Assembly) to be completed in the first quarter of 2025.
Agreed on the policy to develop and implement the National Target Program on Population and Development for the period 2026 - 2035; assign the Party Committee of the Government of Vietnam to direct the development of this Program and submit it to the National Assembly in the third quarter of 2025.
- Assigned the Central Inspection Committee to advise and amend the Regulations of the Central Committee, the Politburo, the Secretariat regarding the handling of violations of population policy and actively amend Guideline 05-HD/TW, dated November 22, 2022, of the Central Inspection Committee in the direction of not disciplining cases of having a third child or more, synchronously with the amendments of the legal provisions (non-retroactive to cases previously disciplined).
- Assigned the Party Committee of the Government of Vietnam, the Party Committee of the Central Public Security to direct the urgent completion of the construction and synchronous connection of data on people (based on the national database on population) to accurately assess population dynamics (both in terms of quantity and quality), serving accurate, prompt, and effective planning and the implementation of population policies in the future.
Thus, upcoming regulations of the Communist Party related to handling violations of population policy will be amended and proactively amend Guideline 05-HD/TW in the direction of not disciplining party members having a third child or more, synchronously with the amendments of the legal provisions (non-retroactive to cases previously disciplined).
(i) Regulation 69-QD/TW in 2022 on disciplining party organizations, party members violating regulations issued by the Central Committee
(ii) Regulation 37-QD/TW in 2021 on prohibitions for party members issued by the Central Committee
(iii) Guideline 05-HD/UBKTTW in 2022 for implementing certain provisions of Regulation 69-QD/TW on disciplining party organizations, party members violating regulations issued by the Central Inspection Committee.
