On July 18, 2024, the Government of Vietnam issued Decree 92/2024/ND-CP on the registration of collaborative groups, cooperatives, and union of cooperatives in Vietnam .

Latest guidance on declaring personal information in the procedures for cooperative registration in Vietnam

According to the provisions of Article 10 of Decree 92/2024/ND-CP, the declaration of personal information in the procedures for registration of collaborative groups, cooperatives, and union of cooperatives in Vietnam is as follows:

- In cases where a personal identification number is available, the person conducting the registration procedure for collaborative groups, cooperatives, and union of cooperatives declares information regarding their surname, middle name, given name, date of birth, and their personal identification number as well as the personal information requirements for the individuals' personal information declaration in the registration documents for collaborative groups, cooperatives, and union of cooperatives. The declared information must be accurate compared to the information stored in the National Population Database.

In cases where the declared personal information differs from the information stored in the National Population Database, the individual is responsible for contacting the competent state management agency to correct the information before carrying out the registration procedures for collaborative groups, cooperatives, and union of cooperatives.

- When submitting registration documents in paper form, the individual submitting the registration documents for collaborative groups, cooperatives, and union of cooperatives must present their citizen identification card or identity card or use an electronic identity account as stipulated by law to handle the registration procedures for collaborative groups, cooperatives, and union of cooperatives.

- In cases where there is no personal identification number, the registration documents for collaborative groups, cooperatives, and union of cooperatives requesting personal information declaration of the lawful representative of the cooperative, union of cooperatives, head of branches, representative offices, business locations, or the person representing the collaborative group if the representative is an individual, or the lawful representative of the organization if the representative is a legal entity must be accompanied by a copy of the identity card or passport or foreign passport or valid substitute documents for the foreign passport of said individual as per regulations.

- In cases where the connection between the Registration Database of Cooperatives and the National Population Database is disrupted, the registration documents for collaborative groups, cooperatives, and union of cooperatives must be accompanied by a copy of the citizen identification card, identity card, or passport or foreign passport or valid substitute documents for the foreign passport of the individual submitting the registration documents, the lawful representative of the cooperative, union of cooperatives, head of branches, representative offices, business locations, or the representative of the collaborative group if the representative is an individual, or the lawful representative of the organization if the representative is a legal entity as stipulated.

- The personal information shared from the National Population Database with the Registration Database of Cooperatives includes:

+ Surname, middle name, and given name;

+ Date of birth;

+ Personal identification number;

+ Gender;

+ Ethnicity;

+ Nationality;

+ Permanent residence;

+ Current residence.

- The district business registration office, the Business Registration Office under the Department of Planning and Investment of the provinces and centrally-administered cities, and state management agencies regarding business registration have the right to access information in the National Population Database to resolve registration procedures for collaborative groups, cooperatives, and union of cooperatives; store and preserve information and data in accordance with the law; ensure safety, confidentiality, and backup to ensure the completeness and integrity of the files for access, use when necessary or to serve inspection, comparison, review, complaint resolution, and information provision upon request from competent agencies or organizations as stipulated.

More details can be found in Decree 92/2024/ND-CP which comes into force in Vietnam from July 18, 2024.
