Latest Detailed Guidance on Procedures and Dossiers for Receiving the Social Insurance Benefits in Vietnam

Vietnam Social Security has just issued Decision No. 777/QD-BHXH on the publication of replaced and abolsihed administrative procedures regarding social insurance benefits and unemployment insurance in Vietnam.

Detailed instructions on procedures for receiving social insurance and unemployment insurance benefits

Attached to the Decision are appendices providing detailed instructions on procedures, implementation methods, and the necessary documents for administrative procedures related to social insurance benefits and unemployment insurance in Vietnam. To be specific:

Type of Insurance Procedures, implementation methods Required documents
Sickness Regime - Employees submit applications as prescribed to the employer.

- The employer gathers applications and processes them, receiving applications from employees within 10 days from the date of receiving complete applications, the employer prepares a List of requests for settlement of sickness and maternity benefits (form 01B-HSB) and submits it to the social insurance agency where the employer contributes social insurance.

- In case of electronic transactions, prepare a digital signed electronic application and send it to the National Social Insurance portal or through an I-VAN organization if not yet converted to paper applications submitted to the social insurance agency via public postal services.

- The social insurance agency receives, reviews the application, and pays benefits to the employee.
- Inpatient treatment

+ A copy of the discharge paper of the employee or the employee's child under 7 years old.

+ Additionally, a copy of the referral or transfer paper in case of referral examination.

- Outpatient treatment: the original Certificate of leave due to sickness for social insurance. In the case both parents take leave to care for the child, a copy of one parent's certificate or the discharge paper indicating additional leave by the doctor.

- In case the employee or their child receives medical treatment abroad: A copy of the Vietnamese translation of the medical certificate issued by the foreign medical facility.

- Attached: The original List 01B-HSB of the employer.
Maternity Regime - Employees submit applications to the employer within 45 days from the date they return to work.

- For those giving birth, adopting a child during the reserved period of social insurance contributions due to termination of employment, demobilization, or discharge before the time of giving birth or adoption: submit applications as prescribed, present the social insurance book to the provincial/district social insurance agency where they reside. In case of not directly receiving the benefit, a power of attorney (form 13-HSB) or a power of attorney contract as prescribed must be prepared.

- The employer receives and prepares the application: Within 10 days from the date of receiving a complete application from the employee, the employer prepares a list of requests for the settlement of sickness, maternity, health recovery and recuperatio benefits (form 01N-HSB) and submits it to the social insurance agency where the employer contributes social insurance.

- In case of electronic transactions, prepare a digitally signed electronic application and submit it to the National Social Insurance portal or through an I-VAN organization if the paper application has not been converted to the social insurance agency via public postal services.

- The social insurance agency receives, reviews, and pays benefits to the employees
- Female employees undergo prenatal care, miscarriage, abortion, stillbirth, or pathological abortion; employees undergo contraceptive measures:

+ In case of inpatient treatment: A copy of the discharge paper of the employee; in case of referral examination and treatment during inpatient treatment, an additional copy of the referral or transfer paper is required.

+ In case of outpatient treatment: Certificate of leave for social insurance; or a copy of the discharge paper indicating additional leave by the treating physician after the inpatient treatment period.

- Female employees giving birth:

+ A copy of the birth certificate or an extract of the birth certificate or a copy of the birth record of the child.

+ In case the child dies after birth: A copy of the birth certificate or an extract of the birth certificate or a copy of the birth record of the child, a copy of the death certificate or an extract of the death certificate or a copy of the death notice of the child; in case the child dies immediately after birth without a birth record, a summarized medical history or discharge paper of the mother or surrogate mother indicating the child's death is required.

+ In case the mother or surrogate mother dies after giving birth, a copy of the death certificate or an extract of the death certificate of the mother or surrogate mother is required.

+ In case the mother, after giving birth, or the surrogate mother after receiving the child is no longer able to care for the child, an additional Medical Examination Council report of the mother or surrogate mother is required.

+ In case of pregnancy requiring leave to recover health as prescribed in Clause 3, Article 31 of the Social Insurance Law 2014, one of the following documents is required:

++ Inpatient treatment: A copy of the discharge paper or a summary of the medical records indicating health recovery leave.

++ Outpatient treatment: Certificate of leave for social insurance indicating health recovery leave.

++ In case of requiring medical examination: Report of Medical Examination Council.

+ In case of surrogate mother giving birth or the recipient mother receiving the child, an additional copy of the agreement on surrogacy for humanitarian purposes as prescribed in Article 96 of the Marriage and Family Law 2014; a document confirming the delivery time of the child by the surrogate and the recipient.

- Employees adopting a child under 06 months old: A copy of the adoption certificate.

- Male employees or the husbands of surrogate mothers taking leave when their wives give birth: A copy of the birth record or a copy of the birth certificate or an extract of the birth certificate of the child; in case of surgical birth or a child born under 32 weeks where the birth record does not indicate so, an additional document from the medical facility indicating surgical birth, or a child born under 32 weeks is required. In case the child dies after birth without issuing a birth record, a summarized medical history or discharge paper of the mother or surrogate mother indicating the child's death is required.

- Male employees or the husbands of surrogate mothers receiving one-time benefits when their wives give birth: A copy of the birth record or a copy of the birth certificate or an extract of the birth certificate of the child. In case the child dies after birth without a birth record, a summarized medical history or discharge paper of the mother or surrogate mother indicating the child's death is required.

- In case of maternity benefits for individuals giving birth, receiving a child, adopting a child during the reserved period of social insurance contribution due to job termination, demobilization prior to the time of giving birth, receiving a child, adopting a child (applies to both giving birth, receiving a child, adopting a child during the employment period from January 1, 2018, onwards who had terminated employment at the employer and submitted a request for benefits at the social insurance agency):

+ In case of giving birth, receiving a child

++ A copy of the birth certificate or an extract of the birth certificate or a copy of the birth record of the child.

++ In case the child dies after birth: A copy of the birth certificate or an extract of the birth certificate or a copy of the birth record of the child, a copy of the death certificate or an extract of the death certificate or a copy of the death notice of the child; in case the child dies immediately after birth without a birth record, a summary of the medical history or discharge paper of the mother or surrogate mother indicating the child's death is required.

+ In case the mother or surrogate mother dies after giving birth, an additional copy of the death certificate or an extract of the death certificate of the mother or surrogate mother is required.


+ In case the mother after giving birth or the surrogate mother after receiving the child is no longer able to care for the child, an additional original Medical Examination Council report of the mother or the recipient mother is required.


+ In case of pregnancy requiring leave for health recovery as prescribed in Clause 3, Article 31 of the Social Insurance Law 2014, one of the following documents is required:


++ Inpatient treatment: A copy of the discharge paper or a summary of the medical records indicating health recovery leave.


++ Outpatient treatment: The original Certificate of leave for social insurance indicating health recovery leave.

++ Medical examination: The original Medical Examination Council report.


+ In case of surrogate mother giving birth or the recipient mother receiving the child, an additional copy of the humanitarian surrogacy agreement as prescribed in Article 96 of the Marriage and Family Law 2014; a document confirming the delivery time of the child by the surrogate and the recipient.


+ In case of medical examination payment, an original invoice, fee receipts, and a list of assessed contents are required.


- In case of adopting a child under 6 months old: A copy of the adoption certificate.
