Circular 49/2017/TT-BCA has been issued by the Ministry of Public Security detailing policies on allowances for judicial examination in the field of forensic science; the composition and number of personnel performing duties during autopsy, post-mortem examination, and exhumation. This document takes effect from January 1, 2018.
if necessary, the Judge must participate in the forensic post-mortem examination. To be specific: Circular 49 stipulates the composition and number of people performing tasks during the examination of post-mortem, autopsy, and exhumation cases as follows:
- Assign no more than 03 forensic technicians to perform tasks during the examination, autopsy, and exhumation of 01 corpse.- Investigators:- Assign 01 investigator to perform tasks during the examination, autopsy, and exhumation of 01 corpse for cases under the jurisdiction of the district-level police.- Assign no more than 02 investigators to perform tasks during the examination, autopsy, and exhumation of 01 corpse for cases under the jurisdiction of the provincial-level police and above.- Procurators:
- Assign 01 procurator to perform tasks during the examination, autopsy, and exhumation of 01 corpse for cases under the jurisdiction of the district-level police.- Assign no more than 02 procurators to perform tasks during the examination, autopsy, and exhumation of 01 corpse for cases under the jurisdiction of the provincial-level police and above.
- Judge: 01 person must participate as needed according to the procedural law.
