Is it possible to transfer from library public employee to teacher?

Regarding this matter, the Department of Internal Affairs of Quang Ninh Province responds as follows:

Currently, according to the regulations in the Law on Public Employees 2010, Decree 29/2012/ND-CP dated April 12, 2012, of the Government of Vietnam on the recruitment, use, and management of public employees, and Circular 12/2012/TT-BNV dated December 18, 2012, of the Ministry of Internal Affairs on professional titles and change of professional titles, the transition of public employees from one professional title to another of the same rank is conducted through the evaluation of professional title transfer (provisions related to public employee type transfer have been abolished).

Based on Article 6 of Circular No. 12/2012/TT-BNV dated December 18, 2012, of the Ministry of Internal Affairs, the evaluation of professional title transfer is stipulated as follows:

The evaluation for transitioning from one professional title to another of the same rank for public employees must ensure the following conditions: Public employees are assigned to new job positions requiring different specialized professional titles of the same rank as the current professional titles they hold; public employees meet the exact standards of the new professional titles.

The process for evaluating the transfer to a different professional title of the same rank for public employees is carried out as such:

The head of the public service provider organizes the evaluation of the training and fostering diplomas and certificates of the public employees; inspects and tests their understanding, professional and operational skills, and other requirements according to the standards of the professional title corresponding to the new job position through interviews or practical assessments; if public employees meet the standards of the professional title corresponding to the new job position, the head of the public service provider issues an appointment decision under his/her authority or requests the competent authority managing public employees to appoint the new professional title.

In reference to the above regulations, the transition from the professional title of a librarian to a teacher for Ms. Nguyen Bao Ngoc must fall under the case of evaluating professional title transfer and must comply with the conditions and procedures stipulated in Clauses 1 and 2, Article 6 of Circular No. 12/2012/TT-BNV dated December 18, 2012, of the Ministry of Internal Affairs.
