Is it possible to postpone conscription with a nearsightedness of 3.5 degrees?

Mr. Trieu Hoang Minh (email: hoangminh****@gmail.com) sent the following question to Thu Ky Luat:I am currently 23 years old, have graduated from college, am working, and am an only child in my family... I have myopia (right eye: 3.5 diopters, left eye: 3.5 diopters), and astigmatism in both eyes at 0.5 diopters. I would like to ask, according to the latest National Military Service regulations, which category do I fall into? And am I eligible for a temporary deferment of military service?

Law Secretary would like to address your query as follows:

According to Section II, Appendix I of the Joint Circular 16/2016/TTLT-BYT-BQP on health classification standards, individuals with myopia are classified as follows:

- Myopia under - 1.5D (Level 2);- Myopia from - 1.5D to under - 3D (Level 3);- Myopia from - 3D to under - 4D (Level 4);- Myopia from - 4D to under - 5D (Level 5);- Myopia from - 5D or more (Level 6);- Myopia that has been surgically corrected for over 1 year with good results is downgraded by 1 level according to uncorrected vision;- Retinal pigment epithelium degeneration due to severe myopia (from -3D upwards) (Level 6).

The health classification is based on the points awarded for the 8 criteria listed on the military service health examination form. Specifically:

- Type 1: All 8 criteria meet Level 1;- Type 2: At least 1 criterion meets Level 2;- Type 3: At least 1 criterion meets Level 3;- Type 4: At least 1 criterion meets Level 4;- Type 5: At least 1 criterion meets Level 5;- Type 6: At least 1 criterion meets Level 6.

Therefore, if you have myopia of 3.5 diopters in both the left and right eyes (Level 4), your health is classified as Type 4.

According to point a, Clause 3, Article 4 of Circular 140/2015/TT-BQP regarding the selection and recruitment of citizens for military service, only those with health classified as Type 1, 2, or 3 are selected according to the health standards for military service set by the Ministry of Health and the Ministry of National Defense. Since your health is classified as Type 4, you are not eligible for conscription.

  1. Health standards:

a) Selection of citizens with health classified as Type 1, 2, or 3 according to the health standards for military service set by the Ministry of Health and the Ministry of National Defense.
