Pursuant to Clause 2 Article 3 of the Circular 2/2023/TT-BGTVT stipulating transitional regulations for vehicles that still have valid Certificate of inspection as follows:
“Inspection Certificates and Inspection Seals issued before the effective date of this Circular shall continue to be used until they expire.”
Therefore, we can understand that for vehicles that have valid Certificate of inspection shall still be used. (promulgated in the Circular 16/2021/TT-BGTVT).
Only when the current Certificate of inspection expires, after passing, the car owner will be granted a Inspection Certificate and Inspection Seal with a new cycle.
Pursuant to the Circular 2/2023/TT-BGTVT, amendments to new inspection cycle deadline are as follows:
- For passenger cars of all kinds with up to 9 seats not operating in transport business:
+ For vehicles manufactured up to 7 years: the first cycle is changed to 36 months (30 months compared to previous regulations), the periodic cycle is 24 months (increased by 6 months compared to 18 months compared to previous regulations).
+ For vehicles manufactured from 7 to 20 years: the first and periodic cycle is 12 months; vehicles manufactured over 20 years, the first and periodic cycle is 6 months.
According to the old regulations of the Circular 16/2021/TT-BGTVT, this cycle only applies to vehicles manufactured from over 7 years to 12 years and over 12 years.
- For passenger cars of all kinds up to 9 seats operating in transport business, the inspection cycle remains the same.
- Meanwhile, according to the new regulations of the Circular 2/2023/TT-BGTVT, passenger cars of all kinds with more than 9 seats, the inspection cycle shall also be divided production time as well as its renovation:
+ For vehicles with a production period of up to 5 years: the first inspection cycle is 24 months, the periodical cycle is 12 months (an increase of 6 months compared to previous regulations of Circular 16/2021/TT-BGTVT).
+ For vehicles with a production period of more than 5 years: the first cycle and the periodic cycle are 6 months.
+ For renovated vehicles, the first inspection cycle is 12 months and the periodic cycle is 6 months.
- General principles
+ The first cycle specified in Section 2 of Appendix XI of the Circular 2/2023/TT-BGTVT shall be applied to the following entities:
Motor vehicles subject to exemption from inspection specified in Clause 3, Article 5 of the Circular 2/2023/TT-BGTVT.
Unused motor vehicles with the period of time between the year of manufacture to the year of submission of the application for the Certificate of first inspection less than 02 years old (year of manufacture plus 01 year).
The time from the year of manufacture to the year of submission of the application for an inspection certificate is determined according to the guidance stated at Point e, Section 1 of Appendix XI of the Circular 2/2023/TT-BGTVT.
+ The periodic cycle specified in Section 2 of Appendix XI of the Circular 2/2023/TT-BGTVT shall be applied to the following entities:
Motor vehicles inspected for the first time are not subject to the application of the first cycle mentioned above.
Motor vehicles that are not inspected for the first time:
- Modified motor vehicles, which are motor vehicles that undergo renovation and conversion of functions or changes to one of the following systems: steering and braking (except for the case where an auxiliary brake pedal is installed).
- Motor vehicles inspected and granted the Certificate of Inspection with a period of 15 days shall not be counted as the first cycle.
- If the motor vehicle is inspected for the next time, the inspection period calculated on a periodic basis is smaller than the inspection period of the previous most recent inspection cycle. The inspection period of the previous most recent inspection cycle corresponds to the "Vehicle Type" in the Inspection Cycle Table but is counted from the date of the previous most recent inspection cycle level.
