Investigation Time Limit for Workplace Accidents in the Ministry of National Defense

Circular 01/2017/TT-BQP has been issued by the Ministry of National Defense, stipulating the declaration, investigation, statistics, and reporting of labor accidents within the Ministry of National Defense.

To be specific, Circular 01 stipulates the time limits for investigating occupational accidents within the Ministry of National Defense as follows:

  1. The time limit for investigating an occupational accident is calculated from the time of receiving the report or declaration of the occupational accident to the time of announcing the investigation minutes of the occupational accident:

- No more than 04 days for a minor occupational accident;- No more than 07 days for an occupational accident causing serious injury to one person;- No more than 20 days for an occupational accident causing serious injury to two or more people;- No more than 30 days for a fatal occupational accident; no more than 60 days for an occupational accident requiring technical appraisal or forensic examination.

In cases where occupational accidents show signs of a crime and are investigated by the Criminal Investigation Agency but later a decision is made not to prosecute a criminal case, the time limit for investigation is calculated from the time the occupational accident investigation team receives all relevant documents, items, and means related to the occupational accident.

  1. For occupational accidents with complex details, the investigation period may be extended once, but the extension period must not exceed the stipulated time; 05 working days before the end of the investigation period, the head of the occupational accident investigation team must report the extension and obtain the consent of the person who decided to establish the occupational accident investigation team.
