Circular 02/2018/TT-TANDTC detailing the trial of criminal cases involving participants under 18 years old under the jurisdiction of the Family and Juvenile Court was issued on September 21, 2018.
This Circular stipulates the interaction between the victim under 18 years old and the defendant as follows:
- Cases where the victim under 18 years old has been sexually assaulted, abused, or trafficked;- Cases where the victim is under 10 years old;- Other cases at the request of the person under 18 years old or their representative and if the Trial Council deems it necessary to isolate to ensure the best interests of the person under 18 years old.
During the trial of the above cases, the victim will participate in the trial in an isolation room. Information about the trial proceedings as well as the exercise of their rights and obligations shall be transmitted via an online audiovisual system or other methods but must ensure they fully follow the proceedings and exercise their rights and obligations.
Representatives, guardians, psychologists or social workers, or child protection officers must be present in the isolation room to support the victim's participation in the trial.
