The Department of Education and Training—Ho Chi Minh City Education Sector Trade Union issued Official Dispatch 266/SGDDT-CDGD 2023 guiding the organization of Labor Conferences at non-public educational establishments in the 2023–2024 school year.
Instructions for organizing Labor Conferences at non-public schools for the 2023–2024 school year.
In particular, the general regulations for organizing the Labor Conference are as follows:
1. Scope and objects of implementation in Vietnam
- Non-public educational establishments belonging to the education and training sector of Ho Chi Minh City.
- Implementing subjects: investor, Chairman of the Board of Directors (employer), Communist Party Executive Committee or Provisional Trade Union Executive Committee, and employees of the unit.
Note: In the event that the employer is absent, a power of attorney must be made for the head of the unit or other responsible member. The authorization content must clearly state the full name and position of the authorized person, as well as the contents allowed to decide and sign legal documents on behalf of the employer during the conference.
2. Purpose of organizing the Labor Conference in Vietnam
- Organize employee conferences in the above units to promote the direct democratic rights of workers, create conditions, and organize dialogue according to the provisions of Decree 145/2020/ND-CP so that employees can know, give opinions, and monitor issues related to legitimate rights and interests, obligations, and responsibilities of employees.
- Through implementing direct democracy at the Workers' Conference, building harmonious and stable labor relations, contributing to preventing and limiting labor disputes, implementing democracy within the legal framework, and contributing to building a strong unit and sustainable development.
- Signing a collective labor agreement between the employer and the Communist Party Executive Committee, the temporary union Executive Committee, or the immediate superior Trade Union Standing Committee at the grassroots level for units that have not yet established a trade union (representing the unit's employees), express agreement in writing according to regulations.
3. Principles of organization in Vietnam
- Conferences of workers in non-public educational units must be held annually. In cases of necessity, the employer or the Executive Committee of the Communist Party of Vietnam proposes to organize an extraordinary Labor Conference.
- The Labor Conference is recognized as valid when it is attended by more than 2/3 of the total number of teachers, staff, and workers, or 2/3 of the total number of delegates approved by the employer, and the Communist Party Executive Committee decides to convene (if it is a delegate conference).
- The resolution of the Labor Conference is only valid when more than 50% of the total number of official delegates attending the conference vote in favor.
- The collective labor agreement is only valid and signed when more than 50% of the total number of official delegates attending the conference vote in favor.
