Instructions for management and issuance of Cards of inspectors in Vietnam according to Decree 43/2023/ND-CP (Internet image)
On October 31, 2023, the Government Inspectorate issued Official Dispatch 2434/TTCP-TCCB on the management and issuance of Cards of inspectors according to Decree 43/2023/ND-CP.
The document clearly states the implementation of the Law on Inspection and Decree 43/2023/ND-CP.
The Government Inspectorate requests ministries and ministerial-level agencies; People's Committees of provinces and centrally run cities; inspect ministries and ministerial-level agencies; and the Inspectorate of provinces and centrally run cities shall manage and issue Cards of inspectors to inspector ranks according to Article 14, Decree 43/2023/ND-CP.
Specifically, Article 14 of Decree 43/2023/ND-CP regulates Cards of inspectors as follows:
- Inspectors shall be provided with cards to use when conducting inspection. Inspection cards shall be provided after the decision to appoint inspectors is issued. Inspection cards shall be revoked when inspectors are dismissed.
The Inspector General of the Government Inspectorate shall stipulate card patterns, provision, management and use of cards. Ministers, heads of ministerial agencies and chairpersons of People's Committees of provinces shall manage and provide inspection cards for inspectors under their management.
- Inspectors shall be responsible for preserving and using cards when performing tasks. It is strictly forbidden to use cards for personal purposes. If inspectors use their cards to commit violations, depending on the nature and danger of such violations, they shall incur disciplinary penalties or face criminal prosecution.
Decree 43/2023/ND-CP stipulates that the funding for sewing and purchasing inspection uniforms and inspection cards for inspectors belonging to any level of inspection agency is guaranteed by the state budget at that level. For agencies under the Government, the financial mechanism of that agency shall be implemented according to the provisions of the law.
Inspection agencies base their decisions on the subjects to be issued inspection cards, inspection uniforms, and the number of types of inspection uniforms up to the prescribed deadline to prepare a budget estimate and send it to the financial agency at the same level for synthesis and submission to the competent authority for approval and funding for sewing and purchasing inspection uniforms, along with the annual budget expenditure estimate. Funds for sewing, purchasing inspection uniforms, and making inspection cards are allocated in addition to the administrative expenditure norms according to the payroll.
Regulations on clothing and inspection cards according to the Law on Inspection
Inspectors are provided with uniforms and inspection cards according to Government regulations for use when performing inspection tasks.
Persons assigned to perform specialized inspection tasks are provided with uniforms and specialized inspection cards according to the regulations of the Minister and Head of Government agencies for use when performing specialized inspection tasks.
Inspection is the activity of reviewing, evaluating, and handling according to the order and procedures prescribed by law by the agency performing the inspection function for the implementation of policies, laws, tasks, and powers of agencies, organizations, and individuals. Inspection activities include administrative inspection and specialized inspection.
Purpose of inspection activities in Vietnam
Inspection activities aim to detect limitations and inadequacies in management mechanisms, policies, and laws to propose to competent state agencies solutions and remedies; prevent, detect, and handle violations of the law; help agencies, organizations, and individuals comply with the law; promote positive factors; contribute to improving the effectiveness and efficiency of state management activities; and protect the interests of the State, the legitimate rights and interests of agencies, organizations, and individuals.
Principles of inspection activities
- Comply with the law, democracy, openness, objectivity, timeliness and accuracy.
- Do not obstruct the normal activities of inspected subjects and other agencies, organizations or individuals.
- No overlap in scope and time between inspection agencies, between inspection agencies and state audit agencies; No duplication in exercising rights when conducting inspections. (According to the Law on Inspection)
