This is an issue of concern stipulated by the Ministry of Justice (BTP) in Circular 15/2015/TT-BTP, detailing the implementation of certain provisions of the Civil Status Law and Decree 123/2015/ND-CP.
According to Circular 15/2015/TT-BTP, the registration of birth for individuals who already have personal dossiers and documents is carried out as follows:
- For Vietnamese citizens residing in the country, born before January 1, 2016 without having registered their birth but possessing personal documents such as: identification documents stipulated in clause 1 of Article 2 of Decree 123/2015/ND-CP; Household registration book; Temporary residence book; other documents issued by competent state agencies of Vietnam and request birth registration, the People's Committee of the commune where the person resides shall handle the birth registration.
- For Vietnamese citizens residing abroad without having registered their birth, if they have personal documents as stipulated in clause 1 of Article 8 of Circular 15, in which the place of birth is recorded in Vietnam and they request birth registration, the People's Committee of the district where they resided before leaving the country shall handle the birth registration.
Note: The birth registration dossier includes:
- Birth registration declaration, a written affidavit stating that the birth registration has not been done yet;
- Documents as stipulated in point b, point c of clause 1 of Article 26 of Decree 123.
