Inspection team must directly send inspection schedule to the unit managing officials and public employees in Vietnam

Recently, the Ministry of Home Affairs issued Decree 39/2007/ND-CP prescribing the procedures and contents of inspections concerning the recruitment, use, and management of officials and public employees in Vietnam.

Article 5 of Circular 09/2012/TT-BNV stipulates the meeting of the Inspection Team and preparation for the implementation of inspections  in Vietnam as follows:

- The Head of the Inspection Team organizes a meeting to thoroughly understand the approved inspection plan; discuss specific measures to organize the implementation of the plan; assign specific tasks to each member of the Inspection Team; state principles of coordination and compliance with the procedures and regulations of the Inspection Team; anticipate a direct inspection schedule at the agency, unit under inspection, and related agencies, organizations, units, individuals in Vietnam;

- Gather documents related to the inspection content issued by the Communist Party, State, and the agency or unit under inspection regarding the recruitment, use, and management of officials and public employees applicable in the scope and period of the inspection;

- Prepare means, equipment, funding, and other necessary material conditions to serve the activities of the Inspection Team.

The formulation of outlines requesting the inspected entity to report is specifically stipulated as follows:

- The Head of the Inspection Team is responsible for presiding over, together with the members of the Inspection Team, the formulation of outlines requesting the inspected entity to report;

- The Head of the Inspection Team sends a document to the inspected entity (including the report request outline and the anticipated direct inspection schedule at the agency, unit under inspection, and related agencies, organizations, units, individuals) at least 6 days before the announcement of the inspection decision.

Note: In the document sent to the inspected entity, the Inspection Team needs to request the inspected entity to formulate and present a report on the implementation of legal regulations on the recruitment, use, and management of officials and public employees at the announcement of the inspection decision; agree on the direct inspection schedule; gather and arrange materials by topic in chronological order, file all documents and materials related to the inspection content regarding the work process of each official and public employee.

The announcement of the inspection decision is specifically stipulated as follows:

- The Head of the Inspection Team is responsible for notifying the inspected entity in writing about the announcement of the inspection decision:

- The content of the announcement notification includes:

- Time and place of the announcement of the inspection decision;

- Participants in the announcement meeting: Inspection Team; Head of the agency or unit under inspection; Head of the unit or organization advising on the management of officials and public employees of the inspected entity; other participants as decided by the Head of the Inspection Team and the head of the agency or unit under inspection.
