Circular 52/2017/TT-BGTVT was issued on December 29, 2017. This Circular stipulates the maintenance of maritime infrastructure. Notably, it includes provisions regarding the quality inspection of maritime works. To be specific:
1. Maritime Construction Quality Inspection is conducted in the following cases:
- Periodic inspections according to the approved maritime construction maintenance procedures;- When it is discovered that parts of the construction or the construction itself show signs of dangerous damage, not ensuring safety for exploitation and use;- When there is a need to assess the current quality status of the construction to establish maintenance procedures for maritime constructions that have been put into use but do not have maintenance procedures;- When it is necessary to have a basis for deciding to extend the use period of maritime constructions that have exceeded their design lifespan or as a basis for renovation and upgrading of the construction;- When required by state management agencies in construction.
2. Selection of Construction Inspection Organizations:
- The organization conducting the inspection must meet the capacity conditions as prescribed, suitable for the inspection field, and have their operational capacity information published on the electronic information portal according to regulations. The person in charge of conducting the inspection must meet the capacity conditions as prescribed, suitable for the inspection field;- In the case of inspection as required by state management agencies in construction as stipulated in point e, clause 1 of this Article, it shall comply with the provisions of Decree 46/2015/ND-CP.
3. Inspection Procedures as Required by the agency at point b, clause 2, Article 13 of Circular 52/2017/TT-BGTVT are as follows:
- The inspection organization develops an inspection outline and submits it to the requesting agency for review and approval;- The investor, owner, or manager, exploiter, and user approve the inspection outline and cost estimates prepared by the inspection organization and sign a contract with this organization according to legal regulations;- The inspection organization conducts the inspection according to the approved inspection outline and submits a report on the inspection results to the requesting agency and the investor, owner, or manager, exploiter, and user;- The investor, owner, or manager, exploiter, and user and the inspection organization conduct the acceptance of the inspection results report and liquidate the contract according to legal regulations on contracts in construction activities.
4. The Inspection Outline includes the following main contents:
- Purpose, requirements, target, and content of the inspection;- List of standards and technical regulations applied;- Information on the capacity of the person in charge and individuals conducting the inspection; laboratories and equipment used for the inspection (if any);- Procedures and methods for conducting the inspection;- Inspection timeline;- Other conditions for conducting the inspection.
5. The Inspection Results Report includes the following main contents:
- Basis for conducting the inspection;- General information about the construction and the inspected target;- Content and sequence of conducting the inspection;- Results of experiments, calculations, analyses, observations, and evaluations;- Conclusions on the contents as per the approved inspection outline and recommendations (if any).
6. Inspection Costs are determined by preparing estimates according to regulations on construction investment cost management and other relevant regulations suitable to the scope of work in the inspection outline, including some or all of the following costs:
- Surveying the current state of the inspected target;- Developing and estimating the inspection outline, verifying the inspection outline and estimates;- Collecting and studying related documentation for the inspection;- Experimenting, calculating, analyzing, observing, and evaluating;- Transportation costs for inspection purposes;- Preparing the inspection results report;- Other necessary costs serving the inspection.
