Inmates Receiving and Using Medical Gifts Must Pay Attention to This Regulation

This is a regulation of interest mentioned in Circular 14/2020/TT-BCA detailing policies on visiting, receiving gifts, and communication of inmates.

Specifically, family members of inmates, when visiting or sending via postal services, can send medication, supplements to the inmate as prescribed by doctors or physicians at the detention facility or at a State medical facility where the inmate has been examined and treated. Medications sent by family members must have labels clearly stating the dosage, usage, place of manufacture, and expiration date.

Additionally, Circular 14/2020/TT-BCA stipulates that medications and supplements sent by family members to inmates must be recorded in a tracking log and stored in a separate cabinet. The medical staff at the detention facility is responsible for checking and managing these medications. When an inmate is ill and needs medication, the medical staff will issue the medication based on the illness and treatment plan, instruct and supervise the inmate's use.

The medication for an inmate must be used by that inmate only, and must be clearly recorded in the medical record and tracking log: “Medication sent by family members.” Inmates receiving and using medication must sign their name or fingerprint (if illiterate) in the medical record or tracking log. Expired medication must be destroyed with an official report, witnessed and signed (or fingerprinted) by the inmate.

Furthermore, when an inmate completes their prison sentence or has to be transferred to another location, the medical staff must check, compare and return the unused medication to the inmate or hand it over along with the inmate's health records to the receiving unit.
