Recently, the Government of Vietnam has issued Decree 133/2020/ND-CP detailing the implementation of several provisions of the Law on Execution of Criminal Judgments.

According to Article 19 of Decree 133/2020/ND-CP, inmates are classified as average if they do not meet the criteria for good or fairly good classification as stipulated in Clauses 2 and 3, Article 19 of Decree 133/2020/ND-CP; or after having a decision recognizing disciplinary violations and showing improvement; or if the period of temporary suspension of prison sentences expires but the inmate does not appear at the detention facility within the prescribed time to continue serving the prison sentence and does not have a legitimate reason.
Inmates in Vietnam are classified as poor if they do not meet the criteria for lawful compliance of serving prison sentences and fail to meet the criteria for average classification or above; have not been recognized for showing progress in reformation; frequently violate the rules of the detention facility and are held separately; commit new offenses during the serving of a prison sentence; make complaints that have been resolved, responded to according to legal regulations but still intentionally make unlawful complaints about the court's judgment, decisions, or other issues related to the inmate serving a sentence; have the court terminate the temporary suspension of the prison sentence or escape and are recaptured to continue serving their prison sentence; do not report the criminal acts committed before serving the prison sentence and are judged by another judgment; are conditionally released but are ordered by the court to return to continue serving the remaining prison sentence.
