This is an important provision stipulated in Decree 10/2015/ND-CP issued by the Government of Vietnam regulating in vitro fertilization and surrogate pregnancy for humanitarian purposes.
Recipients of sperm, oocytes, and embryos for the purpose of performing in vitro fertilization, pregnancy, and childbirth must comply with the conditions stipulated in Decree 10/2015/ND-CP, specifically:

- Recipient of sperm must be the wife in a couple undergoing infertility treatment where infertility is due to the husband or a single woman desiring to conceive and whose oocytes are of sufficient quality for fertilization.
- Recipient of oocytes must be a Vietnamese person or of Vietnamese origin and must be the wife in a couple undergoing infertility treatment where infertility is due to the wife not having oocytes or having oocytes that are not of sufficient quality for fertilization.
- Recipient of embryos must belong to one of the following cases:
+ The wife in a couple undergoing infertility treatment where infertility is due to both the wife and the husband;
+ The wife in a couple undergoing infertility treatment where the couple has attempted in vitro fertilization but failed, except in cases of surrogacy;
+ A single woman who does not have oocytes or whose oocytes are not of sufficient quality for fertilization.
Additionally, recipients of sperm, oocytes, and embryos must be in good health to undergo in vitro fertilization, pregnancy, and childbirth; must not have sexually transmitted diseases, HIV, or infectious diseases in groups A, B; must not have genetic diseases that affect future generations, must not have mental diseases or other conditions that prevent them from perceiving and controlling their own behavior.
Note: Medical facilities must absolutely not provide names, ages, addresses, and images of recipients of sperm and embryos.
