On December 30, 2019, the Government of Vietnam promulgated Decree 100/2019/ND-CP on sanctioning administrative violations in the field of road and railway traffic.

Alongside the substantial increase in penalties for numerous violations of road traffic regulations, this Decree also includes additional violations subject to penalties.
To be specific, point a Clause 6 Article 48 of Decree 100/2019/ND-CP stipulates a fine from 8,000,000 VND to 12,000,000 VND for national railway infrastructure businesses, urban railway businesses, and specialized railway businesses that commit any of the following violations:
"a) Absence of a Railway Traffic Accident Resolution Council or Railway Traffic Accident Analysis Council when a railway traffic accident occurs as stipulated;"
Thus, according to this new regulation, effective from January 1, 2020, urban railway businesses and specialized railway businesses without a Railway Traffic Accident Resolution Council or Railway Traffic Accident Analysis Council when a railway traffic accident occurs will be subject to a maximum fine of 12,000,000 VND.
This is a new regulation added in Decree 100/2019/ND-CP as the previous Decree 46/2016/ND-CP did not include penalties for this violation.
The significant increase in penalties for numerous violations and the addition of new penalized violations aim to enhance the law compliance awareness of individuals and organizations, thereby contributing to the reduction of traffic accidents annually.
