On April 23, 2024, the Prime Minister issued Decision 333/QD-TTg on the implementation plan for the exploration, extraction, processing and use of minerals for the period 2021 - 2030, with a vision towards 2050.

The Prime Minister issued the implementation plan for the exploration, extraction, processing and use of minerals in Vietnam for the period 2021 - 2030, with a vision towards 2050, which includes the following objectives and requirements:

(1) Objectives

- Efficiently implement Decision 866/QD-TTg dated July 18, 2023 of the Prime Minister approving the exploration, extraction, processing and use of minerals for the period 2021 - 2030, with a vision towards 2050 (Mineral Planning), establish a roadmap for effective implementation of programs and projects to achieve the goals, tasks, and solutions set out in the plan.

- Specify the schedule, implementation steps, and resources for implementing programs and projects to develop policies and solutions to attract social resources in implementing the plan.

- Assign specific responsibilities to ministries, sectors, and localities, especially in resolving or reporting to competent authorities on the difficulties regarding mechanisms and policies during the implementation of the plan.

- Focus on researching and resolving obstacles to implement urgent and important projects in priority areas such as national security projects, infrastructure projects, transportation, especially public investment projects, projects mobilizing social resources, projects for renovating and upgrading infrastructure to serve local socio-economic development.

(2) Requirements

- The implementation plan for the Mineral Planning ensures feasibility and effectiveness, adheres to and inherits approved resolutions, strategies, action programs, sectoral planning, and related implementation plans.

- Ensure feasibility and flexibility in implementing projects during each period, in line with the national context and resources.

- Demonstrate close coordination between relevant agencies during the implementation of the Mineral Planning.

Furthermore, the land use plan is determined as follows:

* Based on the provisions of Clause 3, Article 47 of the Law on Planning, the land use plan for implementing national-level plans (including national sectoral plans) will be led by the Ministry of Natural Resources and Environment, in coordination with ministries, ministerial agencies, and provincial People's Committees submitting to competent authorities for issuance. Specifically, the principles for developing the land use plan for mineral extraction projects are as follows:

- Implement mineral extraction projects with the aim of promptly returning land funds to localities for implementing other socio-economic development projects, minimizing the impact of mineral areas on local land use plans.

- Adjust the land use plan and progress of implementing exploration and mineral extraction projects when proposed by provincial People's Committees for certain mineral areas with specific characteristics: large reserves, widespread distribution, exploitation through open-pit methods with shallow depths, such as bauxite, titanium, etc., based on the principles of protecting and developing state assets, ensuring the recovery and protection of mineral resources to implement urgent and important projects, especially public investment projects; technical infrastructure projects for national interests and public benefits specified in Article 62 of the Land Law 2013; projects mobilizing social resources, projects for renovating and upgrading infrastructure to serve local socio-economic development based on the provisions of Article 26, Article 28 of the Law on Minerals, Law on Planning, and related laws.

* The estimated total land demand for the Mineral Planning for the period 2021 - 2030 is about 190,000 hectares and about 305,000 hectares in the period 2031 - 2050 (excluding projects that have been granted mining licenses before the approval of this Decision). The land demand calculation is in line with Resolution 39/2021/QH15 dated November 13, 2021 of the National Assembly on the National Land Use Plan for the period 2021 - 2030, with a vision towards 2050, and the National Land Use Plan for the 5-year period 2021 - 2025.
