This is an important provision stipulated in Decree 116/2020/ND-CP regulating the policy on tuition support and living allowances for pedagogical students in Vietnam, issued on September 25, 2020.
How to recover tuition support and living allowances provided to pedagogical students in Vietnam? (Illustration)
According to Article 9 of Decree 116/2020/ND-CP, the procedure for recovering expenses already provided to pedagogical students is as follows:
Annually, based on the training and academic results of pedagogical students, the teacher training institution shall notify the list of students subject to the provisions at point c, clause 1, Article 6 of Decree 116/2020/ND-CP to the provincial People's Committee to announce the recovery of funds already provided to pedagogical students and their families according to the provisions at clause 2, Article 8 of Decree 116/2020/ND-CP.
For pedagogical students subject to the reimbursement of funds according to the provisions at points a and b, clause 1, Article 6 of Decree 116/2020/ND-CP, the provincial People's Committee shall issue a notice to recover the support funds so that the pedagogical student or their family can repay in full the amount to be reimbursed as prescribed in Article 8 of Decree 116/2020/ND-CP.
Within 30 days from the date of receiving the decision from the competent state authority, the student or family must contact the fund recovery agency to complete the reimbursement procedures.
The maximum period to fulfill the obligation to reimburse support funds is 4 years from the time the pedagogical student receives the recovery notice.
In the case that the student or family delays fulfilling the reimbursement obligation beyond the prescribed time limit, they must bear the maximum interest rate applicable to demand deposits stipulated by the State Bank of Vietnam for amounts delayed in reimbursement. If the State Bank does not specify the maximum interest rate for demand deposits, the interest rate of the Vietnam Joint Stock Commercial Bank for Industry and Trade at the time when the reimbursement obligation is fulfilled shall apply.
Pedagogical students required to reimburse funds according to clause 1, Article 6 of Decree 116/2020/ND-CP, if they belong to a policy beneficiary group or have difficult circumstances, the provincial People's Committee shall decide the recovery method, policies for exemption, reduction, or cancellation of reimbursement based on the specific conditions and characteristics of the students.
The recovered funds from the reimbursement of pedagogical students shall be submitted to the state budget according to the current budget management decentralization and the provisions of the Law on State Budget regarding the management of recovered amounts submitted to the budget.
If the pedagogical student or their family does not fulfill the reimbursement obligation, the fund recovery agency has the right to file a lawsuit in court according to legal provisions.
