How to record the Certificate of Adoption in Vietnam according to Circular 12

This is the main content stipulated in Circular 12/2011/TT-BTP guiding the recording, archiving, and using forms for adoption issued by the Ministry of Justice of Vietnam on June 27, 2011.

How to record the Certificate of Adoption in Vietnam according to Circular 12 (Internet image)

Pursuant to Article 6 of Circular 12/2011/TT-BTP guiding the method to record the Certificate of Adoption as follows:

1. The full names of the adoptive father, adoptive mother, and adopted child must be written in capital letters, with full diacritics.

2. The section "Place of registration of child adoption" must clearly state the name of the commune-level People's Committee of the commune/ward/commune-level town, district/district, province/city under central authority for domestic adoption registration or the name of the Vietnamese representative agency abroad if the adoption is registered at the Vietnamese representative agency abroad; the section "Date of registration" must accurately reflect the date of registration of the child adoption.

For the re-registration of child adoption as stipulated in Article 29 of Decree No. 19/2011/ND-CP dated March 21, 2011, of the Government of Vietnam, detailing the implementation of certain articles of the Law on Adoption (hereinafter referred to as Decree 19/2011/ND-CP), the name of the re-registering agency and the date of re-registration must be noted.

3. The "Notes" section should be written as follows:

- For the re-registration of child adoption under Article 29 of Decree No. 19/2011/ND-CP, write "Re-registration."

- For the practical adoption registration under Article 25 of Decree No. 19/2011/ND-CP, write "Practical adoption recognized since day... month... year..." which is the date the practical adoption relationship between the parties was established.

- In the case of domestic child adoption where the biological parents have a written agreement with the adoptive parents regarding the retention of certain rights and obligations towards the child after adoption, write "Biological parents and adoptive parents have an agreement according to Clause 4 Article 24 of the Law on Adoption."

More details can be found in Circular 12/2011/TT-BTP, which comes into effect in Vietnam from August 15, 2011.
