How to handle when someone is found using drugs illegally in Vietnam?

Recently, the Government of Vietnam issued Decree 221/2013/ND-CP regulating policies on the application of administrative handling measures for compulsory rehabilitation centers in Vietnam.

According to Decree 221/2013/ND-CP, when detecting someone using drugs illegally, the communal police where the person has committed the violation shall make a record of the illegal drug use behavior and carry out verification, collect documents, and prepare a dossier proposing the application of compulsory rehabilitation measures. If an individual or organization detects someone using drugs illegally, they should report to the communal police where the violation occurred to make a record and verify, collect documents, and prepare a dossier:

- In the case where the violator resides in the commune, ward, or commune-level town where the violation occurred and has been educated at the commune, ward, or commune-level town due to drug addiction, a dossier proposing the application of compulsory rehabilitation measures shall be prepared as prescribed in Clause 1, Article 9 of Decree 221/2013/ND-CP;

- In the case where the violator's residence is not in the commune, ward, or commune-level town where the violation occurred, the violator and the violation record shall be handed over to the communal police where the violator resides to prepare a dossier proposing the application of compulsory rehabilitation measures as prescribed in Clause 1, Article 9 of Decree 221/2013/ND-CP. The handover must be recorded, and each party retains a copy;

- In the case where a stable residence of the violator has not been determined, efforts shall be made to determine the stable residence. Within 15 working days, if a stable residence is determined, the above two cases shall apply; if a stable residence is not determined, a dossier proposing the application of compulsory rehabilitation measures shall be prepared as prescribed in Clause 2, Article 9 of Decree 221/2013/ND-CP.
