On March 2, 2018, the Ministry of Transport issued Circular No. 09/2018/TT-BGTVT providing guidance on how to handle situations when a train is obstructed.
Circular 09 stipulates the resolution procedures when there is an incident causing blockage on the train route as follows:
At the boarding passenger station:
- Passengers have the right to refuse to board the train and request a full refund of the amount indicated on the ticket;- In case passengers accept to wait for the train, the enterprise must arrange for the passengers to board the next available train as soon as possible.
On the transportation route:
- If passengers wish to return to the departure station, the enterprise must arrange for the passengers to return on the first available train without requiring a ticket payment. Upon return, passengers may disembark at an intermediate station if the train stops there. The enterprise must refund the ticket amount for the portion from the alighting station to the destination station as indicated on the ticket;- In case passengers disembark at a station where the train stops and request a ticket refund, the enterprise must refund the ticket for the remaining segment the passenger has not traveled;- In case passengers wait at a station where the train has to stop to continue later, the enterprise must ensure minimal living conditions such as free food and drinks during the waiting time at the station;- In case the enterprise has to organize transshipment, the enterprise must ensure minimal living conditions for the passengers.
Note, the ticket refund period must not exceed 30 days from the date the passenger disembarks.
