How to determine the successful candidate in the latest civil servant recruitment exam under latest regulations in Vietnam (Internet image)
Regarding this issue, LawNet would like to answer as follows:
On December 7, 2023, the Government issued Decree 85/2023/ND-CP amending Decree 115/2020/ND-CP on the recruitment, use, and management of public employees.
According to Clause 5, Article 1 of Decree 85/2023/ND-CP amending Article 10 of Decree 115/2020/ND-CP, determining successful candidates in the civil servant recruitment exam is as follows:
(i) A person who passes the civil servant recruitment exam must meet the following conditions:
+ Have test scores in round 2 of 50 points or more.
+ Have a higher score in round 2 plus priority points specified in Article 6 of Decree 115/2020/ND-CP (if any) taken in order of score from high to low in the recruitment criteria of the job position.
(ii) In case there are 02 or more people whose total points calculated as prescribed in Point b, Clause 1, Article 10 of Decree 115/2020/ND-CP are equal to the final target of the job position to be filled, the successful candidate is the person who achieves a higher result in the general knowledge test in round 1 (if any).
In case it is still not possible to determine, the head of the recruitment agency shall decide on the successful candidate.
(iii) In case you register for 02 wishes but are not accepted in choice 1, you will be considered for choice 2 if the job position registered in choice 2 still has a recruitment quota after considering all wishes 1, including the wishes of people with lower admission results as prescribed in Clause 4, Article 18 of Decree 115/2020/ND-CP.
In case there are 02 or more people with the same score in choice 2, the successful candidate will be determined according to the provisions in clause (ii).
In case the job position still has a recruitment quota after considering all 02 aspirations, based on the exam results, the Exam Council reports to the head of the agency with recruitment authority to decide on recruitment for people whose recruitment results are immediately lower than the recruitment results of those who are successful in a job position at another unit but have the same standards and conditions as the standards and conditions of the job position at the unit that still has recruitment quotas, the same exam council, the same exam or writing format (round 2), and the same exam questions.
The person recruited in this case must have test scores in round 2 of 50 points or more. For job positions with no applicants, the head of the recruitment agency decides on recruitment according to this regulation.
(iv) Persons who are not recruited in the civil servant recruitment exam specified in this article may not reserve their exam results for future recruitment exams.
Previously, according to Article 10 of Decree 115/2020/ND-CP, the regulations for determining successful candidates in the civil servant recruitment exam were as follows:
- Applicants who pass the civil servant recruitment exam must meet the following conditions:
+ Have test scores in round 2 of 50 points or more.
+ Have a higher score in round 2 plus priority points specified in Article 6 of Decree 115/2020/ND-CP (if any) in order of score from high to low in the recruitment quota for each job position.
- In case there are 02 or more people whose total points calculated as prescribed in Point b, Clause 1, Article 10 of Decree 115/2020/ND-CP are equal to the final target of the job position to be filled, the person with a higher score in round 2 will be the one who is accepted. If it still cannot be determined, the head of the agency or unit with authority to recruit public employees will decide on the successful candidate.
- People who do not pass the civil servant recruitment exam cannot reserve their exam results for future recruitment exams.
More details can be found in Decree 85/2023/ND-CP, taking effect on December 7, 2023.
