How the Legal Affairs Department Monitors the Implementation of Laws in the Industry and Trade Sector?

The content is detailed in Circular 35/2013/TT-BCT issued by the Minister of Industry and Trade, amending and supplementing certain provisions of Circular 25/2011/TT-BCT on the regulations concerning inspection, handling, review, systematization, and monitoring the implementation of legal normative documents in the field of Industry and Trade.

The Legal Department is responsible for overseeing the enforcement of laws in the industry and trade sectors, specifically as stipulated in Circular 35/2013/TT-BCT as follows:

- Preside, cooperate with units to develop the annual Plan for monitoring the enforcement of laws of the Ministry and submit it to the Ministry's leadership for issuance;- Organize inspections, investigations, surveys, and assessments of the enforcement of laws in the industry and trade sectors for the specialized topics conducted by the Department according to the annual Plan for monitoring the enforcement of laws;- Coordinate and urge other units in the implementation of monitoring the enforcement of laws in the industry and trade sectors as led by these units in accordance with the annual Plan for monitoring the enforcement of laws;- Report to the Minister and propose measures to handle the results of monitoring the enforcement of laws;- Annually summarize and prepare reports on the monitoring of the enforcement of laws in the industry and trade sectors to be submitted to the competent authorities as required.

Additionally, other units under the Ministry of Industry and Trade are also responsible for monitoring the enforcement of laws:

- Develop an annual Plan for monitoring the enforcement of laws of the unit, submit it to the Legal Department for consolidation and then submit it to the Ministry Leadership for issuance of the Ministry’s annual Plan for monitoring the enforcement of laws;- Organize inspections, investigations, surveys, and assessments of the enforcement of regulatory documents related to the unit’s functions and duties;- Organize the implementation of specialized inspections, investigations, surveys, and assessments of the enforcement of laws conducted by the unit according to the Ministry’s annual Plan for monitoring the enforcement of laws;- Coordinate with the Legal Department to report to the Minister and propose measures to address issues;- Submit semi-annual reports to the Legal Department on the monitoring of the enforcement of laws related to the unit’s functions and duties.
