Recently, the Government of Vietnam issued Decree No. 37/2019/ND-CP on elaboration of the Law on Planning.
According to Decree No. 37/2019/ND-CP of Vietnam’s Government, the time limit for formulating planning is prescribed as follows:
- The time limit for formulating the national comprehensive planning, national marine spatial planning, national land use planning or regional planning is no more than 30 months from the date on which the planning tasks are approved, including 18 months within which components of the national comprehensive planning, national marine spatial planning or regional planning are formulated.
- The time limit for formulating national sector planning or provincial planning is no more than 24 months from the date on which the planning tasks are approved.
Also according to Decree No. 37/2019/ND-CP, requirements on issues concerning planning formulation include:
- Name of the planning; planning boundary and period;
- Viewpoints, objectives and rules for formulating planning;
- Forecasting of development prospect and demand during the planning period;
- Main contents of the planning;
- Main contents of components of national comprehensive planning, national marine spatial planning and regional planning;
- Strategic environmental assessment report, regarding the planning required to undergo strategic environmental assessment in accordance with regulations on environmental protection;
- Composition, number, standard and format of planning documentation.
Relevant provisions can be found in Decree No. 37/2019/ND-CP of Vietnam’s Government, which takes effect from May 07, 2019.
