Recently, public opinion has been abuzz about the act of altering National High School Exam scores by officials in Ha Giang. Many questions have been raised around this issue, notably concerning the legal responsibility of those who commit violations in this case.
Point d, Clause 1, Article 48 of the National High School Exam Regulations issued together with Circular 04/2017/TT-BGDDT stipulates that depending on the severity of the violation, one may be forced to resign or be recommended for criminal prosecution for intentionally modifying scores on the exam paper, in the scoring record, or in the score sheet.
In the case of criminal prosecution, the individual who alters the scores of the National High School Exam in Ha Giang can be prosecuted under the charge of forgery in office as stipulated in Article 359 of the Criminal Code 2015. The imprisonment ranges from 01 to 05 years for acts of altering or falsifying the content of documents and records.
Moreover, the offender shall be banned from holding certain positions or engaging in certain professions from 01 to 05 years and shall be fined from 10 million VND to 100 million VND.
Article 359. Offense of Forgery in Office 1. Any person who, for personal gain or other personal motives, abuses his/her position or authority to carry out any of the following acts shall be sentenced to between 01 and 05 years of imprisonment: a) Altering or falsifying the content of documents and records; b) Making or issuing fake documents; c) Forging signatures of persons holding positions of authority. 2. Committing the offense in any of the following circumstances shall be sentenced to between 03 and 10 years of imprisonment: a) Organized; b) The offender is responsible for issuing or making documents and records; c) Making or issuing fake documents in quantities ranging from 02 to 05 fake documents. 3. Committing the offense in any of the following circumstances shall be sentenced to between 07 and 15 years of imprisonment: a) Making or issuing fake documents in quantities ranging from 06 to 10 fake documents; b) To commit a less serious or serious crime. 4. Committing the offense in any of the following circumstances shall be sentenced to between 12 and 20 years of imprisonment: a) Making or issuing fake documents in quantities of 11 fake documents or more; b) To commit a very serious or particularly serious crime. 5. The offender shall also be banned from holding certain positions or practicing certain professions from 01 to 05 years and may be fined from 10,000,000 VND to 100,000,000 VND. |
