How are Collaborative Relationships in Health Inspection Activities Regulated?

Recently, the Government of Vietnam issued Decree 122/2014/ND-CP on the organization and activities of Health Inspection.

Decree 122/2014/ND-CP prescribes the working relationship in health inspection activities as follows:

- The Inspectorate of the Ministry of Health shall be under the direction and guidance regarding inspection work and expertise from the Government Inspectorate of Vietnam; responsible for guiding the specialized inspection expertise to the Health Inspectorate of the Department of Health, the General Department, and the Departments under the Ministry of Health; guide or take the lead in organizing inter-sectoral inspections; guide internal inspection work.

- The Health Inspectorate of the Department of Health shall be under the direction and guidance regarding administrative inspection work and expertise from the provincial inspectorate and the direction and guidance regarding specialized inspection work and expertise from the Inspectorate of the Ministry of Health; guide specialized inspection expertise to the Sub-Departments under the Department of Health; responsible for sending inspectors to participate in inspections organized by the Inspectorate of the Ministry of Health or to organize unexpected inspections at the request of the Inspectorate of the Ministry of Health.

- The General Departments and Departments under the Ministry of Health, tasked with performing specialized inspections, shall be under the direction and guidance regarding inspection expertise from the Inspectorate of the Ministry of Health; cooperate with the Health Inspectorate of the Department of Health in guiding the Sub-Departments under the Department of Health tasked with performing specialized inspections to build inspection plans and implement them; send officials tasked with performing specialized inspections to participate in inspections organized by the Inspectorate of the Ministry of Health or to organize unexpected inspections at the request of the Inspectorate of the Ministry of Health.

- The Sub-Departments under the Department of Health, tasked with performing specialized inspections, shall be under the direction and guidance regarding inspection expertise from the Health Inspectorate of the Department of Health and the relevant General Departments and Departments under the Ministry of Health; send officials tasked with performing specialized inspections to participate in inspections organized by the Health Inspectorate of the Department of Health or to organize unexpected inspections at the request of the Health Inspectorate of the Department of Health.

- Health inspection agencies within their respective responsibilities and authority must cooperate with police agencies, market management agencies, other specialized inspection agencies, the People's Committees at all levels, and relevant agencies and organizations in preventing, detecting, and handling violations of the law in general and violations of health regulations in particular.

- Police agencies, border guards, market management agencies, other specialized inspection agencies, the People's Committees at all levels, and relevant agencies and organizations within their respective responsibilities and authority must cooperate with health inspection agencies in preventing, detecting, and handling violations of the law in health activities.
