The New Year and Lunar New Year holidays for employees are stipulated in the Labor Code 2012 and Decree 45/2013/ND-CP. To facilitate tracking for our esteemed members, Thu Ky Luat is pleased to share the specific 2018 New Year and Lunar New Year holiday schedule as follows:
New Year's Day
Based on Point a, Clause 1, Article 115 of the Labor Code 2012 which stipulates: Employees are entitled to 1 day off on New Year's Day with full salary. Furthermore, New Year's Day 2018 falls on a Monday, thus the leave schedule for New Year's Day will be as follows:
- For officials and public employees and employees working at establishments with a 2-day/week off policy: Leave from Saturday, December 30, 2017 to Monday, January 01, 2018 (3 consecutive days off).- For employees working at establishments with a 1-day/week off policy: Leave from Sunday, December 31, 2017 to Monday, January 01, 2018 (2 consecutive days off).
Lunar New Year
According to Point b, Clause 1, Article 115 of the Labor Code and Article 8 of Decree 45/2013/ND-CP, which stipulates: Employees are entitled to 5 days off during Lunar New Year with full salary; The Lunar New Year leave schedule is chosen by the employer as 1 day at the end of the old year and 4 days at the beginning of the new lunar year or 2 days at the end of the old year and 3 days at the beginning of the new lunar year.
Therefore, the Lunar New Year holiday schedule will be as follows:
For employees working at establishments with a 2-day/week off policy (7 consecutive days off):
- Option 1: Leave from the 29th of the twelfth lunar month of the Year of the Monkey to the 5th of the first lunar month of the Year of the Dog (From February 14 – February 20, 2018).- Option 2: Leave from the 30th of the twelfth lunar month of the Year of the Monkey to the 6th of the first lunar month of the Year of the Dog (From February 15 – February 21, 2018).
For employees working at establishments with a 1-day/week off policy (6 consecutive days off):
- Option 1: Leave from the 29th of the twelfth lunar month of the Year of the Monkey to the 4th of the first lunar month of the Year of the Dog (From February 14 – February 19, 2018).- Option 2: Leave from the 30th of the twelfth lunar month of the Year of the Monkey to the 5th of the first lunar month of the Year of the Dog (From February 15 – February 20, 2018).
Note: The holiday schedule for officials and public employees receiving salaries from the State budget will be regulated by the Government Office of Vietnam each year and will be updated by Thu Ky Luat at the earliest time.
