On September 6, 2024, the Ministry of Education and Training issued Official Dispatch 5154/BGDDT-PC providing guidance for the school year 2024-2025 regarding legal affairs.

To be specific, in the school year 2024-2025, higher education institutions and pedagogical colleges shall fully implement the legal affairs tasks stipulated in Decree 56/2024/ND-CP, and also focus on performing the following specific tasks:

(1) Regarding organization and development of legal affairs personnel:

- Consolidate and promote the role of the legal affairs organization within the unit;

- Enhance the capacity of the legal affairs team at higher education institutions; assign legal affairs staff to participate in training and professional development courses organized by the Ministry of Education and Training and other relevant Ministries and sectors;

(2) Regarding advisory and consulting work on legal issues related to the organization, management, and operations of the school:

- Higher education institutions need to review internal documents to ensure that regulations in these documents have been updated according to the new provisions in the Law, Resolutions of the National Assembly, Decrees of the Government of Vietnam, Decisions of the Prime Minister of the Government of Vietnam, Circulars of the Ministers; based on this, plan to amend, supplement, or issue new internal documents to ensure the issuance basis, content, and adjustment scope conform to superior documents.

- If new Regulations/Rules have replaced previous ones, it is necessary to clearly define that the new Regulations/Rules replace the old ones to establish the basis for determining the rights, obligations, and responsibilities of the entities implementing the Regulations/Rules.

- Recommend higher education institutions to focus on standardizing the internal documents system (with a specific plan for amending, supplementing, or issuing new documents; having a Regulation on the process of issuing school regulations, rules, etc.). Standardizing the internal documents system serves as a basis for implementing work processes and operational processes of constituent organizations and the school, contributing to creating a standardized working environment, and clarifying the rights and responsibilities of each unit and individual.

- Research and develop a new internal documents system ensuring alignment with the current reality of higher education institutions. Concurrently, review the system of documents that have already been issued by the school, correctly determine the authority, form, and document type for issuance to ensure conformance.

- Advise on exercising autonomy ensuring school governance in accordance with the law, preventing, promptly detecting, and rectifying violations; monitor legal compliance, implement democratic regulations in the activities of higher education institutions, and hold those in authoritative positions accountable according to their assigned functions and duties; oversee the management and use of finance and assets of higher education institutions; provide feedback on draft legal documents developed by the Ministry of Education and Training.

(3) Regarding the work of communication, dissemination, and education of legal awareness:

- Continue implementing Decision 435/QD-BGDDT dated January 30, 2024, issuing the Plan on legal dissemination and education for the education sector in 2024, publicizing, and disseminating directives on higher education management innovation, newly issued documents related to the organization, operation, and mission of the school; documents related to the rights and obligations of teachers, students, and employees; new regulations related to the education and training field, especially issues of public concern, so that teachers, students, and employees understand, share, support, and contribute more to the sector;

- Innovate and diversify forms of legal dissemination and education; enhance the application of information technology, electronic and computing means in serving teaching and learning legal knowledge;

- Continue to pay attention to enhancing the work of legal dissemination, education, and organizing the response to Vietnam's Law Day with the orientations stated in point d, clause 1, Part II of Official Dispatch 5154/BGDDT-PC.

(4) Regarding monitoring the implementation of the law and managing the monitoring of the law on handling administrative violations:

- Implement the Plan for monitoring the implementation of the law on handling administrative violations according to Decision 436/QD-BGDDT dated January 30, 2024, issued by the Minister of Education and Training in Vietnam on the Plan for monitoring the implementation of the law and monitoring the handling of administrative violations in 2024 within the scope of assigned functions and duties;

- Monitor, supervise, and inspect related departments in implementing the state's legal documents, management documents, directives, and operational documents of the school.
