According to the guidelines in Resolution 01/2010/NQ-HDTP, illegal gambling is defined as gambling conducted in any form where the stakes are money or items of value that are not authorized by the competent state authority, or if authorized by the state, it does not comply with the regulations in the issued permit.
Thus, any person participating in Gourd Crab Fish Tiger for the purpose of gambling (i.e., betting money) is considered to be engaging in illegal activities and may face administrative fines or criminal penalties depending on the amount of money involved.
Illegal gambling with stakes below 2 million VND will incur a fine of 1 - 2 million VND as stipulated in Article 26 of Decree 167/2013/ND-CP. To be specific:
- Illegally gambling with one of the forms such as xoc dia, ta la, to tom, tu lo kho, tam cuc, 3 cay, tu sac or other forms which are lost or won in cash or in kind;
- Gambling with machine or illegal electronic games;
- Betting in cash or in other forms in sports competition, entertainment or other activities;
- Selling illegal lottery sheet or printed matters used for playing illegal lottery;
Illegal gambling will only be criminally prosecuted if it meets one of the following two conditions:
(1) The stakes involve money or items of value worth 2 million VND or more; or
(2) The stakes are below 2 million VND but the person has previously been convicted of the crime of gambling as stipulated in Article 248 of the Criminal Code, or the crime of organizing gambling or housing gambling as stipulated in Article 249 of the Criminal Code, but has not yet had their criminal record expunged and has reoffended.
