Hanoi-Vietnam: The School Council of a public primary school has at least 07 members

Recently, the Vietnam Ministry of Education and Training issued Circular 28/2020/TT-BGDĐT promulgating the Charter for Primary Schools.

The Charter issued with Circular 28/2020/TT-BGDDT specifically stipulates the School Council of a public primary school in Vietnam as follows:

- The School Council of a public school is the school's governing body, exercising the ownership rights of the school and the related stakeholders, responsible for deciding on the school's operational direction, mobilizing, and supervising the use of resources dedicated to the school, linking the school with the community and society, ensuring the achievement of educational objectives.

- The composition of the School Council of a public primary school includes the secretary of the CPV committee; the principal; the president of the labor union; the secretary of the Ho Chi Minh Communist Youth Union; representatives of specialized teams and administrative team, representatives of local authorities and the parent committee.

- The School Council has a president, vice president, secretary, and other members. The number of members of the School Council is a minimum of 07 people and a maximum of 11 people.

- Duties and powers of the School Council of a public primary school: Resolving decisions on the strategy, vision, plan, and development goals of the school in each phase and each academic year; resolving decisions on the regulations or amendments, supplements to the organization's regulations and activities of the school to submit to the competent authority for approval; resolving decisions on the policy of using the school’s finances, assets; supervising the school’s activities; supervising the implementation of the School Council’s resolutions, the implementation of democratic regulations in the school’s activities.

- The operation of the School Council of a public primary school is regulated as follows:

+ The School Council meets regularly at least three times a year. In necessary cases, when the principal or at least one-third of the School Council members request it, the president of the School Council has the authority to convene an extraordinary meeting to resolve issues arising during the implementation of the school’s duties and power. The president of the School Council may invite representatives of local authorities and unions to attend the School Council meeting when necessary.

+ The School Council meeting is considered valid when at least three-quarters of the members, including the president, are present. The resolutions of the School Council are passed and take effect when at least two-thirds of the attending members agree. The resolutions of the School Council are publicly announced.

+ The school principal is responsible for implementing the resolutions or conclusions of the School Council on the content regulated. If the principal does not agree with the School Council's resolution, they must promptly report and seek the opinion of the school's direct higher educational management authority. While awaiting the competent authority's opinion, the principal must still implement the School Council's resolution on matters not contrary to current laws and this Charter.
