Hanoi-Vietnam: The Exam Council for rank promotion to professional titles of public employees must consist of 05 or 07 members
Specifically, Article 38 of Decree 115/2020/ND-CP stipulates that the Exam Council or Consideration Council for rank promotion to professional titles of public employees is established by the head of the organization or unit with the authority to organize the exam or consideration for rank promotion to professional titles. The Council consists of 05 or 07 members, including:
- The Chairman of the Council, who is the head or the deputy head of the organization or unit with the authority to organize the exam or consideration for rank promotion to professional titles;
- The Vice Chairman of the Council, who is the head or the deputy head of the division advising on personnel organization of the organization or unit with the authority to organize the exam or consideration for rank promotion to professional titles;
- Council members are individuals with related expertise and professional skills in organizing the exam or consideration for rank promotion to professional titles, decided by the head of the organization or unit with the authority to organize the exam or consideration for rank promotion to professional titles, with one member concurrently serving as the Secretary of the Council.
Notably, the Exam Council or Consideration Council for rank promotion to professional titles works on a collective principle and makes decisions by majority vote; in case of a tie, the decision follows the position voted by the Chairman of the Council.
Additionally, the Council has the following tasks and powers:
- Announcing the plan, time, regulations, form, content, and location of the exam or consideration for rank promotion to professional titles;
- Establishing auxiliary divisions: the Examination Committee, Invigilation Committee, Processing Committee, Grading Committee, Re-evaluation Committee (if any) when organizing the examination for rank promotion to professional titles or the Application Review Committee, Inspection, Evaluation Committee when organizing the consideration for rank promotion to professional titles. If necessary, the Chairman of the Council may establish a Secretariat to assist;
- Organizing fee collection for the exam or consideration for promotion and utilizing it as per regulations;
- Organizing the examination, grading, re-evaluation, or organizing application review, inspection, and evaluation as per the rules;
- Reporting to the head of the organization or unit with the authority to organize the exam or consideration for rank promotion to professional titles to recognize the results of the exam or consideration;
- Resolving complaints, and denunciations during the organization of the exam or consideration for rank promotion to professional titles;
- The Exam Council or Consideration Council for rank promotion to professional titles dissolves itself after completing its tasks.
Note: Persons with relationships like parents, siblings, or direct relatives of the exam or promotion candidates, or their spouses (or their spouse's side); spouses, biological children, or adopted children of the candidates; or persons currently under disciplinary action or serving a disciplinary decision cannot be members of the Exam Council or Consideration Council for rank promotion to professional titles, or members of the auxiliary divisions of these Councils.
