Hanoi-Vietnam: Regulations on procurement and bidding in the use of foreign aid

This is important content stipulated in Circular 06/2011/TT-BGDĐT on the management and use of foreign aid issued by the Vietnam Ministry of Education and Training on February 11, 2011.

According to Article 17 of Circular 06/2011/TT-BGDDT, the regulations on procurement and bidding in use of foreign aid are as follows:

1. Procurement and bidding are conducted based on the content of international treaties to which the Socialist Republic of Vietnam is a member, or international agreements signed by competent authorities of the Socialist Republic of Vietnam.

2. The project management board is responsible for formulating an overall and phased bidding plan based on actual conditions, project documents, and the approved activity plan, avoiding duplicate investments with other projects. Unless otherwise required by the donor, the bidding plan must be implemented following the template issued by the Ministry of Planning and Investment as per Circular 02/2009/TT-BKH dated February 17, 2009, providing guidelines for developing bidding plans.

The application for the evaluation of the bidding plan must include a written report on the implementation status of the previous phase's bidding plan and propose solutions for unresolved packages (if any).

3. The project management board shall submit the invitation for tenders of large-scale packages (as defined in the project's operation regulation), the list of expert groups in bid evaluation (the members of which must have complete bidding certificates from a capable training and bidding institution), and the bid evaluation results for evaluation and approval by the Project Owner. Depending on the package scale as specified in the operation regulation, the project management board is responsible for submitting to the Ministry for evaluation and approval of contract negotiation results and contract content.

In special circumstances during bidding that exceeds the decision-making authority, the project management board must report to the Project Owner for timely guidance as per regulations.

4. In cases where the governing body, ODA project owner, or foreign non-governmental aid owner does not establish a project management board, the unit assigned to manage and operate the project shall perform the duties of the project management board stipulated in Clauses 2 and 3 of Article 17 of Circular 06/2011/TT-BGDDT.
