Regarding this matter, LawNet answers as follows:

On April 26, 2024, the Chief Inspector of the Government of Vietnam issued Circular 05/2024/TT-TTCP stipulating the form of Inspector cards and the issuance, management, and use of Inspector cards.

Article 8 of Circular 05/2024/TT-TTCP stipulates the issuance and replacement of Inspector cards from June 15, 2024 as follows:

Cases for issuance and replacement of Inspector cards

- Issuance of new Inspector cards applies to individuals eligible to prepare applications for the initial appointment to the rank of Inspector.

- Replacement of Inspector cards in the following cases:

+ Inspectors promoted to a higher rank;

+ Inspector cards have expired;

+ Due to changes in card number, surname, first name, working agency or other reasons leading to changes in the information of the cardholder.

Applications for issuance and replacement of Inspector cards

The application for issuance and replacement of Inspector cards includes:

- Official Dispatch requesting the issuance or replacement of Inspector cards;

- List requesting issuance or replacement of Inspector cards following Form No. 01 and Form No. 02 attached to Circular 05/2024/TT-TTCP;

- Decision or a copy of the decision on appointment to the rank of Inspector;

- 02 color portrait photos of the individual in inspection attire, size 20 mm x 30 mm, clearly stating the name, and unit on the back of the photo;

- The old Inspector card with a cut corner (for cases of card replacement).

Procedures for issuance and replacement of Inspector cards

The procedures for issuance and replacement of Inspector cards are as follows:

- Chief Inspectors of urban and rural districts, towns, provincial cities, and cities under municipalities submit a written request for the issuance or replacement of Inspector cards to the Chief Inspector of the province.

Chief Inspectors of provincial police, Chief Inspectors of the authorities inspected by the Ministry of National Defense send the written request to the Chief Inspector of the Ministry of Public Security, Chief Inspector of the Ministry of National Defense.

Chief Inspectors of General Departments, Departments under the Ministry submit the written request to the Chief Inspector of the Ministry;

- Chief Inspector of the Ministry, Chief Inspector of the province, Chief Inspector of Vietnam Social Security, Chief Inspector of Cipher Agency review, compile a list, and send a written request to the Minister, Chairman of the Provincial People's Committee, Director General of Vietnam Social Security for issuance, reissuance, replacement of Inspector cards.

For Inspectors under the Government Inspectorate, the head of the directly managing unit shall send a written request for issuance or replacement of Inspector cards to the Personnel Organization Department for compilation, submission to the Chief Inspector of the Government for issuance, replacement of Inspector cards for Inspectors under the Government Inspectorate;

- Based on the application and the written request, the Minister, Chairman of the Provincial People's Committee, and Director General of Vietnam Social Security reviews and decides on the issuance, and replacement of Inspector cards and directs the printing, issuance, and replacement of Inspector cards.

Cases of revocation of inspection cards from June 15, 2024

The revocation of inspection cards shall be carried out in the following cases:

- Inspectors are dismissed from office according to the provisions of Article 42 of the Law on Inspection 2022, including:

+ Undergoing retirement, resignation, change of major;

+ Being unable to complete the assigned tasks due to health, family circumstances or other reasons;

+ Being convicted by a court and the judgment or decision has taken legal effect;

+ Performing prohibited acts specified in Article 8 of the Law on Inspection 2022;

+ Failing to complete tasks for 01 year in the appointed rank;

+ The person appointed to the rank commits acts of fraud in the rank promotion exam or makes an untruthful declaration in the dossier of appointment to the rank;

+ Other cases as prescribed by law on officials and public employees.

- Cases of replacement of inspection cards as prescribed in Clause 2, Article 8 of Circular 05/2024/TT-TTCP.
