Hanoi-Vietnam: Persons holding leading and managerial positions are entitled to late retirement

This is the notable content in the Draft Decree stipulating the retirement age and eligibility requirements for receiving a pension in Vietnam.

In Article 5 of Draft Decree on retirement age and eligibility requirements for receiving a pension, officials and those appointed to positions or titles specified in Appendix No. 01 issued with this Decree may retire at an older age to continue holding leading and managerial positions.

The competent authority decides on the retirement age for officials according to Clause 1 of this Article, but the retirement age for these officials must not exceed 5 years compared to the provisions of Article 3 of this Decree at the retirement time shown in the table below:

Additionally, the decision on late retirement for the above entities must ensure the following principles and conditions:

- Late retirement must ensure objectivity, fairness, transparency, and conformity.

- The agency needs to utilize the personnel.

- The individual has the desire, is in good health, and is not under disciplinary review, investigation, prosecution, trial, or disciplinary action by the party or government.

Note: During the implementation of the policy of late retirement, if the officials wish to stop working, they will be granted a pension according to the legal provisions, regardless of the eligible age for pension at retirement time.
