Hanoi-Vietnam: New regulations on the application for enjoyment of social insurance benefits from May 01, 2019

Decision 166/QD-BHXH officially takes effect from May 1, 2019 with several new regulations regarding the application for the enjoyment of social insurance benefits in Vietnam. Readers may refer to details on this issue in the table below.

Benefits Components of the application
Sickness Benefits

- List 01B-HSB prepared by the employer along with other applications

- Inpatient treatment:

+ A copy of the discharge note of the employee or the employee's child under 7 years old. In case the patient dies at a medical facility, it is replaced by a Death Certificate; if the death certificate does not specify the hospitalization time, it should be accompanied by documents from the medical facility showing the hospitalization time.

+ In case of referral for further treatment during inpatient treatment, an additional copy of the referral note or transfer note is required.

- Outpatient treatment: Certificate of leave period covered by social insurance (original). If both parents take leave to care for their child, one parent's certificate of sickness leave period can be a copy; or the discharge note with a recommendation from the treating physician for additional rest after inpatient treatment.

- The aforementioned applications shall be replaced with copies of Vietnamese translations in cases where the employee or the employee's child receives treatment abroad.

Maternity Benefits

- List 01B-HSB prepared by the employer along with the following applications.

- For female employees going for prenatal check-ups, miscarriage, abortion, stillbirth, or pathological abortion; and employees implementing contraceptive measures:

+ Inpatient treatment: A copy of the discharge note of the employee; if referred for further treatment during inpatient treatment, an additional copy of the referral note or transfer note is required.

+ Outpatient treatment: Certificate of sick leave for social insurance; or a copy of the discharge note with a recommendation from the treating physician for additional rest after inpatient treatment.

- For female employees giving birth

+ A copy of the birth certificate, birth extract, or birth report of the child.

+ If the child dies after birth: In addition to a copy of the birth certificate, a copy of the death certificate, death extract, or notice of death of the child; if the child dies right after birth without being issued a birth report, it will be replaced by an abstract or summary of the medical record or the discharge note of the mother or the surrogate showing the child's death.

+ If the mother or surrogate dies after giving birth, a copy of the death certificate or death extract of the mother or the surrogate is required.

+ If the mother after giving birth or the woman commissioning the surrogacy cannot care for the child due to poor health, an additional medical assessment report is required for the mother or the commissioning woman.

+ When pregnant and having to take leave to rest as per hospital recommendation, one of the following documents is required:

++ Inpatient treatment: A copy of the discharge note or summary of the medical record showing the need for rest.

++ Outpatient treatment: Certificate of sick leave for social insurance showing the need for rest.

++ Medical assessment required: medical assessment report.

+ If the surrogate gives birth or the commissioning woman receives the child, an additional copy of the humanitarian surrogacy agreement; and a document confirming the handover of the child at the agreed time.
 

- Employee adopting a child under 06 months old: A copy of the adoption certificate.

Lump-sum Social Insurance payout

- Social insurance book.

- Application form according to form 14-HSB.

- For those going abroad to reside, an additional copy of the competent authority's certification of renunciation of Vietnamese nationality or a notarized or certified Vietnamese translation of one of the following documents is required:

+ Foreign passport.

+ Visa issued by competent foreign authorities confirming permission to emigrate for residency abroad.

+ Documents confirming the process of acquiring foreign nationality; documents confirming or residence permit, permanent residence card valid for five years or more issued by competent foreign authorities.

- In case of having life-threatening diseases such as cancer, polio, cirrhosis of the liver, severe leprosy, severe tuberculosis, HIV transitioning to AIDS stage, an additional abstract/summary of the medical record showing inability to self-serve is required; if suffering from other diseases, it is replaced by a medical assessment report by the medical assessment council showing a work capacity decrease of 81% or more and inability to self-serve.

- In case of medical assessment expenses reimbursement, additional invoices, receipts of assessment fees, and a list of assessment contents from the assessment facility are required.

- Personal declaration about service time and location in the army with regional allowances according to form 04B-HBKV (issued along with Circular 181/2016/TT-BQP for those with service time in the army before January 1, 2007, at locations with regional allowances where the social insurance book does not fully reflect the information needed to calculate the regional allowance).

Survivor allowance

- For relatives of individuals currently paying social insurance premiums, preserving the period of social insurance premium payment:

+ Social insurance book.

+ A copy of the death certificate, notice of death, death extract, or copy of the court’s effective decision declaring the individual dead.

+ Declaration form for relatives according to form 09-HSB.

+ Medical assessment report by the medical assessment council for relatives with a work capacity decrease of 81% or more (original, if the employee has a previous assessment report for other policies and meets the conditions for benefits, a copy is acceptable) or a copy of the disability certificate showing a special level of severity (equivalent to a work capacity decrease of 81% or more) as per Circular 01/2019/TT-BLDTBXH for monthly death allowance due to work capacity decrease.

+ In cases of death caused by occupational accidents or diseases, an occupational disease treatment record or an occupational accident investigation report is required.

+ In case of medical assessment expenses reimbursement, additional invoices, receipts of assessment fees, and a list of assessment contents from the assessment facility are required.

+ Personal declaration about service time and location in the army with regional allowances according to form 04C-HBKV (issued along with Circular 181/2016/TT-BQP for those with service time in the army before January 1, 2007, at locations with regional allowances where the social insurance book does not fully reflect the information needed to calculate the regional allowance.

- For relatives of individuals currently receiving or temporarily suspended from receiving a pension, monthly social insurance allowance :

+ Includes the documents listed in points 2, 3, 4, and 6 for relatives of individuals currently paying social insurance premiums, preserving the period of social insurance premium payment.
