On July 01, 2024, the Ministry of Justice (Hanoi, Vietnam) issued Decision 1235/QD-BTP announcing the amendment and supplementation of administrative procedures in the field of judicial records under the management scope of the Ministry of Justice.
- Order of execution:
+ The person requesting the issuance of the Judicial record card submits the application at the National Center for Judicial Records directly, through postal services, or online.
+ The person requesting the issuance of the Judicial record card registers to receive the result at the place of submission or via postal services or receives the electronic result through the Ministry of Justice's Administrative Procedure Resolution Information System (for cases where the application is submitted through the National Public Service Portal or the Ministry of Justice's Administrative Procedure Resolution Information System).
- Method of implementation:
+ Submit the application directly at the National Center for Judicial Records, Ministry of Justice.
+ Send the application via postal services.
+ Submit the application online on the National Public Service Portal or the Ministry of Justice's Administrative Procedure Resolution Information System.
- Components of the application:
+ Declaration form requesting the issuance of the Judicial record card according to the prescribed form (Form No. 03/2024/LLTP; Form 04/2024/LLTP; Form 12/2024/LLTP; Form 13/2024/LLTP).
+ A copy of the ID card or Citizenship Card or Citizen Identification Card or passport of the Vietnamese citizen who cannot determine the place of permanent or temporary residence/ Passport copy of a foreigner who has resided in Vietnam (If submitting a photo copy, the original must be presented for comparison. If the original is not available for comparison, a notarized copy must be submitted in accordance with the law). For foreigners who have resided in Vietnam, the passport must be stamped by Vietnam’s immigration control unit.
+ Authorization document if authorizing another person to request the issuance of Judicial record card No. 1 (If the person being authorized is the parent, spouse, or child of the authorizer, no authorization document is needed). The authorization document must be notarized according to the laws of Vietnam or the laws of the country where the person is a citizen or a permanent resident. If the authorization is made under the laws of the country where the person is a citizen or a permanent resident, the authorization document must be consularly legalized according to Vietnam’s laws and translated into Vietnamese.
An individual requesting the issuance of Judicial record card No. 2 cannot authorize another person to request the issuance of the Judicial record card on their behalf.
- Number of applications: 01 set
- Processing time: Within 10 days from the date of receiving a valid request. In cases where the person granted the Judicial record card is a Vietnamese citizen who has resided in multiple places or has resided abroad, a foreigner, or cases requiring verification of conditions for automatic criminal record expungement, the time limit is no more than 15 days.
