On November 15, 2016, the Vietnam Minister of Finance issued Circular 305/2016/TT-BTC prescribing fees for digital certificate status protocol maintenance, collection, transfer, management and use thereof.
Under Circular, the fee rate for maintaining the status of digital certificates applies to organizations and enterprises licensed to provide digital signature authentication services for organizations and enterprises to use.
The fee rate for digital certificate status protocol maintenance in Vietnam is 3,000 VND/digital signature/month, and the fee collector is the National Electronic Authentication Center affiliated to the Ministry of Information and Communications.
The Circular also stipulates that organizations and enterprises licensed to provide digital signature authentication services declare and pay the service fees for digital certificate status protocol maintenance quarterly, no later than the 20th day of the following quarter.
In addition, the Circular also stipulates that the fee collector must send the collected fees of the previous month into the designated state budget account opened at the State Treasury and carry out the declaration, collection, and payment of fees according to Clause 3, Article 19, Clause 2, Article 26 of Circular 156/2013/TT-BTC and Decree 83/2013/ND-CP.
The fee collector is allowed to retain 90% of the collected fees to cover the costs related to fee collection and pay the remaining 10% of the collected amount to the state budget.
Circular 305/2016/TT-BTC comes into effect on January 1, 2017. For digital signatures granted to organizations and enterprises before January 1, 2017 by organizations and enterprises providing digital signature authentication services, fees shall be paid from the third quarter of 2017.
