Hanoi-Vietnam: Failure to distinguish types of training for persons applying for recruitment of public employees

This is the main content stipulated in Decree 115/2020/ND-CP issued by the Government of Vietnam on the recruitment, employment, and management of public employees on September 25, 2020.

Hanoi-Vietnam: Failure to distinguish types of training for persons applying for recruitment of public employees

Article 5 of Decree 115/2020/ND-CP stipulates the conditions for applying for rerecruimenrt of public employees as follows:

  • The conditions for registering for recruitment are implemented according to the provisions of Article 22 of the Law on public employees. The agencies and units with the authority to recruit public employees stipulated in Clause 1, Article 24 of the Law on Public Employees can supplement other conditions according to the job position requirements stipulated in Point g, Clause 1, Article 22 of the Law on Public employees, but these must not be lower than the general standards, must not contravene legal provisions, and must not discriminate based on the type of training.

  • Individuals registering for positions in public service providers in the fields of culture, arts, physical training, and sports can be younger than 18 years old but must be at least 15 years old and have written consent from their legal representative.

Additionally, this Decree also stipulates the bases for recruitment of public employees as follows:

  • Recruitment of public employees must be based on work demand, job positions, professional title standards, and the salary fund of the public service provider.

  • The agencies and units with the authority to recruit public employees must develop a recruitment plan, report to the competent authority managing public employee matters for approval, or decide within their authority as a basis for each recruitment period. The recruitment plan content includes:

  • The number of persons assigned and the number of unused positions in the public service provider using public employees;

  • The number of public employees needed for each job position;

  • The number of job positions needed for ethnic minorities (if any), clearly specifying the target and ethnic structure needed;

  • Standards and conditions to register for each job position;

  • Forms and content of the recruitment examination or selection review;

  • Other contents (if any).
