The following article contains content regarding the handling violations against regulations on implementation of democracy in agencies and units in the operations of the State Audit Office of Vietnam, as stipulated in Decision 1659/QD-KTNN in 2024.

On September 26, 2024, the State Auditor General issued Decision 1659/QD-KTNN on the Regulation for implementing democracy in the activities of the State Audit Office.
According to the provisions of Article 7 of the Regulation issued with Decision 1659/QD-KTNN of 2024, the handling of violations against regulations on implementation of democracy in agencies and units in the operations of the State Audit Office of Vietnam is as follows:
- Agencies and units that violate legal provisions concerning the implementation of democracy at the grassroots level and the regulations in the Regulation issued with Decision 1659/QD-KTNN of 2024, depending on the nature and severity of the violation, will be handled according to the provisions of the law; if damage is caused, compensation must be made in accordance with the law.
- Officials and public employees, workers committing violations of the law concerning the implementation of democracy at the grassroots level, abusing their positions and powers to violate the legal provisions on the implementation of democracy at the grassroots level, and the Regulation issued with Decision 1659/QD-KTNN of 2024, will, depending on the nature and severity of the violation, be disciplined or criminally charged; if damage is caused, compensation must be made in accordance with the law.
Additionally, according to the provisions of Article 71 of the State Audit Law 2015, the handling of violations in the activities of the State Audit Office is as follows:
Agencies, organizations, and individuals committing legal violations concerning the state audit will, depending on the nature and severity of the violation, be handled according to the provisions of the law.
Prohibited acts in the activities of the State Audit Office are specifically stipulated in Article 8 of the State Audit Law 2015 including:
- The following acts are prohibited for the State Audit Office, State Auditors, and State Audit collaborators:
+ Harassment, causing difficulties, and trouble for the audited unit;
+ Illegal interference in the normal activities of the audited unit;
+ Offering, receiving, and mediating bribes;
+ Reporting false, incomplete audit results;
+ Exploiting positions and powers for personal gain;
+ Disclosing state secrets, professional secrets of the audited unit;
+ Disclosing information on the situation and audit results not officially announced.
- The following acts are prohibited for the audited unit and agencies, organizations, and individuals related to audit activities:
+ Refusing to provide information and documents for the audit as requested by the State Audit Office and State Auditors;
+ Obstructing the work of the State Audit Office and State Auditors;
+ Reporting false, dishonest, incomplete, prompt, or biased information related to the audit of the State Audit Office;
+ Bribing, offering bribes to State Auditors and State Audit collaborators;
+ Concealing legal violations concerning public finance and public property.
- All agencies, organizations, and individuals are prohibited from illegally interfering in the audit activities, audit results of the State Audit Office, State Auditors, and State Audit collaborators.
