Handling Overlapping Internal Inspection Activities of Market Management?

Recently, the Ministry of Industry and Trade officially issued Circular 20/2019/TT-BCT stipulating the internal inspection of law compliance in the public service activities of the Market Management force.

In Clause 5 of Circular 20/2019/TT-BCT, it is stipulated that in the case where, at the same time, the same subject being an official or Market Management authority has overlapping activities in law enforcement in public service activities of the Market Management force (hereinafter referred to as internal inspection), the internal inspection will be decided by the Director-General.

On the other hand, the periodic internal inspection list of the Department must not coincide with the list of Market Management authorities subject to periodic internal inspection of the Directorate. In necessary cases, the Director-General and the Director issue a decision to amend and supplement the periodic internal inspection plan and send it to the relevant Market Management authority for acknowledgement and implementation.

This Circular also stipulates, based on the state management requirements, that the Director-General shall decide to issue the periodic internal inspection plan for the following year of the Directorate before December 20 each year. The issued decision will be immediately sent to the relevant Market Management authority for acknowledgement and implementation.

Based on the Directorate’s plan and the actual state management requirements at the unit, the Director shall decide to issue the periodic internal inspection plan for the following year of the Department before December 30 each year. The issued decision will be immediately sent to the relevant Market Management authority for acknowledgement and implementation; and sent to the Directorate for reporting and monitoring the implementation.
