On November 16, 2017, the Government of Vietnam promulgated Decree 129/2017/ND-CP on regulations for the management, use, and exploitation of irrigation infrastructure property in Vietnam.

According to Article 30 of Decree 129/2017/ND-CP, irrigation infrastructure property that are lost or destroyed due to natural disasters, fires, and other causes as prescribed by law shall be handled. The Minister of Agriculture and Rural Development of Vietnam decides or delegates the authority to decide on the handling of irrigation infrastructure property under their management, and the Provincial People's Council delegates the authority to decide on the handling of irrigation infrastructure property within their management scope.
Therefore, the order and procedures for handling irrigation infrastructure property in cases of loss or destruction are stipulated as follows:
- Within 30 days from the date the loss or destruction of the assets is discovered, the agency assigned to manage the assets shall prepare a Record of Determination of lost or destroyed assets; report to the competent authority on the status of the lost or destroyed assets and the responsibility of the related organizations and individuals. The dossier requesting handling includes:
- A written request for asset handling from the managing authority: 01 original copy;- A list of lost or destroyed assets (type, quantity, original cost, remaining value according to accounting records) according to Form No. 06/TSTL-DM issued with this Decree: 01 original copy;- Documents proving the loss or destruction of the assets: 01 copy.
- Within 30 days from the date of receiving the report, the competent authority specified in Clause 2 of this Article shall review and decide on the handling;
- Within 30 days from the date of receiving a complete and valid dossier, the competent authority specified in Clause 2 of this Article shall decide on the Handling of irrigation infrastructure property in cases of loss or destruction in Vietnam.
- Within 30 days from the date the handling decision by the competent authority specified in Clause 2 of this Article is issued, the managing agency shall conduct accounting to reduce the value of the assets as prescribed by accounting laws; report asset changes as specified in this Decree.
